Sievers Pit M-77-098 SWSP, Oldcastle SW Group, Inc. Page 2 of 12
August 7, 2025
• Removal of the surface water pond located on the west side of the gravel pit from
surface water evaporation calculations, as the pond is used for operations at the
adjacent golf course community. Under the previous SWSP approval, the Applicant
diverted surface water from the Crystal River via the Kaiser-Sievers Ditch for
temporary storage in a 0.7-acre storage pond before the water was used in an
aggregate wash plant at the site. The storage pond did not expose groundwater. This
pond, now used for the Golf Course's operations, is no longer subject to this SWSP.
In accordance with the letter dated April 30, 2010 (attached) from DRMS, all sand and gravel
mining operators must comply with the requirements of the Colorado Reclamation Act and
the Mineral Rules and Regulations for the protection of water resources. The April 30, 2010
letter from DRMS requires that you provide information to DRMS to demonstrate you can
replace long-term injurious stream depletions that result from mining related exposure of
groundwater. In accordance with approach no. 1, the Applicant has indicated that a bond has
been obtained for $962,447 through DRMS to assure that depletions from groundwater
evaporation do not occur in the unforeseen event or events that would lead to the
abandonment of the gravel pit. In addition, the Sievers Pit will be backfilled and reclaimed
once mining is complete, thus eliminating any long-term injurious stream depletions related
to exposure of groundwater.
SWSP Operation
The Sievers Pit is located in Section 13, Township 7 South, Range 89 West and Section 18,
Township 7 South, Range 88 West of the 6th P.M., and operated pursuant to an augmentation
plan that was decreed on July 25, 1984 by the Division 5 Water court in case no. 83CW65.
Oldcastle has been mining under DRMS Permit No. M-77-098 since 2013 and has expanded
mining and water uses beyond the decreed amounts outlined in case no. 83CW65. This SWSP
will replace depletions incurred by the expansion only. This SWSP will work in conjunction
with the augmentation plan to replace depletions from 1.9 acres of exposed groundwater
from dewatering trenches and ponds, water lost with mined product, and dust control.
