Reach 13 that flows around
the North and East sides of the refuse pile was also in good condition. Both the East and West sediment ponds
were found with standing water during the inspection. The ponds can be seen in Photos Five and Six, respectively.
The water and sediment levels were below the discharge elevation, and no evidence of discharge was noted. The
banks appeared to be stable, and the inlets to both ponds were clear from obstruction and flowing freely.

At the Ute Barn area, the sediment control structure was observed to be in good condition and functioning as
designed. No evidence of over topping or significant erosion was noted. Adjacent to the sediment trap is a pile of
material that has been cleaned out from the trap itself. The Operator indicated the monitoring and maintenance of
the trap is ongoing. Evidence of recent flow and impoundment was noted; however no standing or flowing water
was noted at the time of the inspection. Photo Seven shows the structure.

At the King II Facility the main sediment pond was observed to contain a significant amount of standing water as
seen in Photo Eight. The water level was below the discharge elevation and no evidence of discharge was noted.
The banks appeared to be stable at the time of the inspection and in good condition. Several of the internal
drainage structures including sumps and ditches were observed during the inspection. All observed internal
structures were found to be functioning as designed and most were actively conveying impacted water to or
towards the main sediment pond. Both the East and West CWD’s at King II were observed to be in excellent
condition. They were free from obstruction and appeared able to function as designed. Examples of the two
CWD’s can be seen in Photos Nine and Ten respectively.

PHOTOGRAPHS
