If out-of-priority depletions from dewatering, dust <br /> suppression, groundwater lost with mined product or washing of mined product use <br /> occur during either Year 1 or Year 2 due to a call being placed on the Gunnison River <br /> by the Redlands Power Canal, releases of replacement water from Crystal Reservoir <br /> can be used to replace depletions in time, location, and amount to prevent injury to <br /> other water rights. As shown in the attached Tables 3 and 4, for the anticipated call <br /> period (estimated as December-April), lagged depletions from the use of water for <br /> dust control, water lost with mined product, washing of mined product, and <br /> management of dewatering operations, will require replacement water in the amount <br /> of approximately 50.76 ac-ft per year without irrigation or 57.11 ac-ft per year with <br /> irrigation. The Applicant has obtained two contracts for replacement water from <br /> Crystal Reservoir for 2 acre-feet per year and 49 acre-feet per year. These contracts <br /> provide enough replacement water to operate under Scenario 1. Prior to the diversion <br /> of water under Scenario 2, the Applicant must obtain a contract for a minimum of <br /> 6.11 ac-ft per year to dispose of excess water from dewatering operations) with the <br /> U.S. Bureau of Reclamation ("BOR") for replacement water from Crystal Reservoir and <br /> provide a signed copy of the contract to the Division Engineer, Water Commissioner, <br /> and State Engineer's office.
