Prior to the diversion of water under Scenario 2 for this plan's purposes, the <br /> Applicant must obtain a contract for a minimum of 6.11 acre-feet per year with <br /> the U.S. Bureau of Reclamation ("BOR") for replacement water from Crystal <br /> Reservoir and provide a signed copy of the contract to the Division Engineer <br /> and Water Commissioner. In the event the Division Engineer determines <br /> additional replacement water is necessary, the Applicant will be required to <br /> obtain a contract with the BOR for the amount of replacement water required <br /> by the Division Engineer. <br /> 7. Approval of this SWSP is for the purposes and amounts as stated herein. <br /> Additional structures, uses and/or consumption will be allowed only if a new <br /> SWSP is approved for those additional structures, uses and/or amounts. <br /> 8. All diversion for dust control, dewatering and irrigation (if it occurs under this <br /> SWSP), shall be measured in a manner acceptable to the Division Engineer. <br /> 9. The Applicant must replace all out-of-priority depletions resulting from <br /> operation under this SWSP, including those lagged depletions that occur to the <br /> stream after the expiration date of this SWSP. <br /> 10.The replacement water that is the subject of this SWSP cannot be sold or <br /> leased to any other entity. As a condition of subsequent renewals of this SWSP, <br /> the replacement water must be appurtenant to this site until all lagged <br /> depletions from diversions for dust control purposes have been replaced.
