EXHIBIT D MINING PLAN (CONT) <br /> areas contain fiber optic lines, telephone lines, gaslines and <br /> electric lines as well as HWY 85 and the railroad tracks . <br /> The western area lies between the South Platte River and HWY <br /> 85 and is currently an active mine . Mining is completed in Phase <br /> 1 and has begun in Phase 2 . Phase 3 is currently stripped and <br /> used as processing and stockpile areas as approved in the <br /> existing plan. There are no county roads or public facilities in <br /> this area. The oil and gas facilities on this side have been <br /> plugged and abandoned and the associated pipelines and support <br /> facilities have been removed. The Platte Valley Canal crosses <br /> this area from north to south and will not be disturbed by <br /> mining. <br /> The eastern area is also used as an active farm with <br /> associated support structures similar to the west side. Two Weld <br /> County Roads (22 & 22 . 5) are adjacent to the eastern area. The <br /> eastern area also has oil and gas facilities, which include four <br /> (4) oil/gas wells, three (3) of which are shut in. "Shut in <br /> wells" is a well which is capable of producing but is not <br /> presently producing. They are usually plugged and abandoned <br /> completely by the Oil/gas company at some time in the future. <br /> The Platteville Ditch runs through and along the east side of the <br /> east parcel . <br /> MAP EXHIBIT C CURRENT CONDITIONS MAP, shows the outline of the <br /> Affected Lands/permit area, the adjacent landowners within 200 <br /> feet of the facility, current topography, hydrologic and surface <br /> features of the property. Of particular note, the western <br /> permit/affected lands line has been moved to run along the road <br /> on top of the berm built by the landowners and/or historical <br /> levees built by the US Army Corps of Engineers along the South <br /> Platte. Over the years, it appears this bank has been lined with <br /> armoring materials along its entire length by multiple <br /> landowners . No mining will take place within a minimum of 150 <br /> feet from the river bank that exists at this time. The under <br /> drain outlet crosses under the embankment and terminates next to <br /> the river. <br /> As mining progresses, a slope of 3 height (3h) to 1 vertical <br /> (lv) from ground surface to the floor of the mine will be created <br /> inside each reservoir. The disturbed areas from the slurry wall <br /> to the water line or top of bank armoring will be left as a <br /> gravel surface instead of being resoiled and seeded. The area <br /> disturbed outside the slurry wall will be resoiled and <br /> revegetated. <br /> The main entrance to the site is via an existing Private <br /> L.G. Everist, Inc.
