Box 3338 <br />Idaho Springs, CO 80452 <br /> <br />RE: Hukill Gulch Millsite, Permit No. M-2009-076, Notice of Temporary Cessation TC-02 Second <br />Period, Notice of Incompleteness <br /> <br />Dear Mr. Maher: <br /> <br />On November 18, 2024, the Division of Reclamation, Mining and Safety (Division) received a notice to revise <br />the permit status of the above listed site to Temporary Cessation (TC). The Division reviewed the information <br />submitted and determined the following items must be addressed prior to the Mined Land Reclamation Board <br />(“MLRB” or “Board”) considering your request for TC: <br /> <br />1. Rule 1.13.5(a) states the initial period of TC shall be the first five (5) years of cessation beginning <br />with the first one hundred eighty (180) day period of production cessation. The notice submitted to <br />the Division incorrectly lists 11/18/2024 as the date of the initial five-year period of TC. According <br />to Division records, the Hukill Mill was last operational in 2019 and no mining activity or <br />production has occurred since. Based on discussions with the Operator, the last activity was in the <br />fall of 2019. Therefore, the Division considers November 18, 2019 to November 18, 2024 the initial <br />five-year period of Temporary Cessation. Additionally, Rule 1.13.5(b) states the second five (5) <br />year period of Temporary Cessation shall begin at the end of the initial period of TC. Therefore, <br />the notice submitted to the Division is for a second period of TC, beginning on November 19, 2024. <br />Please acknowledge this notice is a request for a 2nd period of TC and confirm the dates of the <br />last activity at the site. <br /> <br />2. The Division received your request to extend the deadline for the additional required corrective <br />actions cited in the September 13, 2024 inspection report. Per your request, the Division will <br />extend the deadline to March 31, 2025 to allow time to address cleaning up abandoned <br />equipment, replacing the silt fence, and installing boundary markers around the lower <br />impoundment area. <br /> <br />3. The Division requests that the Operator address two critical items by December 20, 2024: <br />a. Please submit evidence that the lime is properly stored on site. <br /> <br />b. Please submit evidence from the Office of the State Engineer that Venture <br />Resources, Inc. is legally able to impound surface water in the tailings impoundment <br />area. The evidence must be submitted within the due date noted above, or please <br />submit a plan for the legal discharge of the impounded water. <br />
