Considering the above, plus the fact that road locations for both Alternatives <br /> #2 and #3 exist in a previously disturbed mine dump area, I will approve <br /> either alternative, depending upon what access agreement can or cannot be <br /> reached between the Aspen Mountain Mining Company and the Aspen Skiing <br /> Company. <br /> Mitigation measures in the enclosed Operationing Plan will be followed. In <br /> addition, all facilities will be located and constructed to blend in well <br /> aesthetically and to have the least impact on skiing and ski safety. However, <br /> it must be recognized that if facilities adversely affect skiing and ski <br /> safety, the proponent will be responsible to properly mark, fence, or other- <br /> wise protect facilities in order to protect the public. (Refer to Clause <br /> 15.(a) of the enclosed Operating Flan.) <br /> The Forest Service decision will relate only to lands administered by the <br /> Forest Service. Decisions by other jurisdictions to issue or not issue <br /> approvals related to this proposal can be made by them based on the disclosure <br /> of impacts available in this document. <br /> The operator may appeal this decision pursuant to CFR 228.14. A notice of <br /> appeal must be filed within 30 days of the date of receipt of the decision. <br /> Notice of appeal must be in writing and submitted to Richard E. Woodrow, White <br /> River National Forest, P.O. Box 948, Glenwood Springs, Colorado 81602. <br /> This decision is also subject to appeal pursuant to 36 CFR 211.18 (Federal <br /> Register, Volume 48, No. 63, March 31, 1983, pages 13420 to 13426). Notice of <br /> appeal must be in writing and submitted to the Forest Supervisor at Box 948, <br /> Glenwood Springs, 81602, within 45 days from the date of this decision.
