• � <br /> DECISION NOTICE <br /> FINDING OF NO SIGNIFICANT IMPACT <br /> AND <br /> ENVIRONMENTAL ASSEB,Rl43NT <br /> Aspen Mountain Mining Corporation <br /> Stefan Albouy Mining Proposal <br /> Emma #2 Lode - CMC 209956 <br /> This Environmental Assessment consists of (1) the enclosed June 11, 1985 <br /> Operating Plan submitted by Stefan Albouy, Aspen Mountain Mining Corporation, <br /> and (2) the enclosed map with two road location alternatives. The Environ- <br /> mental Assessment/Decision Notice is available for public review at the Aspen <br /> Ranger District office, 806 West Hallam, Aspen, Colorado 81611. <br /> This proposal is located in the SW1/2 of Section 18, T.AOS., R.84W., and the <br /> SW1/4 of Section 13, T.10S., R.85W, 6th Principle Meridian on the Aspen Ranger <br /> District, White River National Forest. The Emma #2 Lode lies in Vallejo Gulch <br /> on Aspen Mountain within the Aspen Mountain Ski Area special use permit <br /> boundaries. <br /> I have considered three alternatives to include (1) No Action, (2) Road <br /> Location A (green route on map) requiring Mr. Albouy to stay entirely on his <br /> claim, and (3) Road Location B (blue route on map) allowing Mr. Albouy to <br /> cross two claims (the Washington #2 and Aspen Mammoth) owned by the Aspen <br /> Skiing Company. <br /> Aspen Mountain Mining Corporation has a properly recorded mineral location and <br /> therefore a legal right to conduct mineral exploration on their mining claims, <br /> so I eliminated the No Action Alternative from further consideration. <br /> Issues and concerns related to the proposal are: <br /> 1. The impacts and effects roads, buildings, and related mining <br /> activities have on skiing and skiing safety. <br /> 2. The impacts and effects mining related activities have on aesthetics. <br /> 3. Can the proponent gain legal access to his claim across the Spar <br /> Gulch Road? <br /> 4. Does the proponent have legal ownership of the existing tunnel portal <br /> since it lies on.tbe property line between the Washington #2 and the <br /> Erma #2? <br /> Both issues 3 and 4 will need resolution between the Aspen Skiing Company and <br /> Stefan Albouy. I have no authority nor desire to make judgments either way. <br />
