The inspection was conducted on October 3, 2024 by Clayton Wein of the Division. Snowcap <br />Coal Company (SCC) did not have a representative available to attend the inspection. The weather was clear with <br />a temperature of 83° F. The ground conditions were dry during the inspection. <br />During the inspection, the Division’s inspector spoke with Mr. Brett Fontanari. Mr. Fontanari discussed a concern <br />he had with his supply of water from his head gate on Rapid Creek. SCC has a consent order for a water <br />augmentation plan approved by the Division of Water Resources that pumps water from the Colorado River back <br />up onto Rapid Creek. The Division does not have jurisdiction over water rights or water use. Outfall 016 <br />serves as the primary discharge outlet for water draining from the mine. The outfall is located in the northeastern <br />portion of the permit area adjacent to Interstate 70. During the inspection, the outfall was discharging at a rate of <br />about 91 gpm (Photo 1). The flow rate data was obtained from the operator’s electronic gauge on the outlet pipe. <br />The rate of flow was consistent with past collected data for this time of the year. The pipe was clear of debris and <br />functioning as designed. No erosional concerns were observed. Outfall 002 is located on the north side of <br />Interstate 70 and to the west of outfall 016. The discharge pipe was not flowing during the inspection (Photo 2). <br />Outfall 002 serves as a secondary mine discharge if the level of water in the mine increased to a higher elevation <br />within the mine. The discharge pipe was unobstructed and in good repair. No indications of erosional concerns <br />were identified. <br />The section in the northern permit boundary referred to as, Tract 70, contains several trenches created by the <br />landowner. The trenches generally run from west to east and have a riser pipe connected to a buried pipeline on
