a BLM approved seed mix to minimize soil loss due to wind-erosion and to maintain soil <br /> viability. <br /> 11. The Holder shall be responsible for control of all State listed noxious weed species on all <br /> disturbed areas. The Holder shall consult with the Authorized Officer and local <br /> authorities for acceptable weed control methods, and shall comply with all applicable <br /> Federal and State laws. Pesticides shall be used only in accordance with their registered <br /> uses within limitations imposed by the Secretary of the Interior. Prior to the use of <br /> pesticides,the Holder shall obtain approval from the Authorized Officer of a Pesticide <br /> Use Proposal showing the type and quantity of material to be used,pests to be controlled, <br /> method of application, locations of storage and disposal of containers, and any other <br /> information deemed necessary by the Authorized Officer. All pesticide applicators must <br /> hold a valid Colorado Qualified Supervisor license or Certified Operator license, and the <br /> license must be valid for the applicable pesticide application category. For all areas <br /> treated, Pesticide Application Records (BLM Form 3-3-94)must be submitted to the <br /> BLM Tres Rios Field Office by November 1 of each year. Pesticide Application Records <br /> must be completed no later than 14 days following the pesticide application and must be <br /> maintained for ten years <br /> 12. The permittee shall protect all survey monuments,witness corners,reference monuments <br /> and bearing trees within and adjacent to the permit area against disturbance during the <br /> process of preparation, mining and reclamation within the permit area. If any monuments, <br /> corners, or accessories are destroyed, obliterated, or damaged during operations,the <br /> permittee shall secure the services of a Registered Land Surveyor to restore the disturbed <br /> monuments, corners, or accessories, at the same location,using surveying procedures <br /> found in the Manual of Surveying Instructions for the Survey of the Public Lands of the <br /> United States. The permittee shall ensure that the Registered Land Surveyor properly <br /> records the survey in compliance with Colorado Revised Statutes 38-53-101 through 38- <br /> 53-112 (1973) and shall send a copy to the Authorized Officer. <br /> 13. The pit will not be used to store any material brought in from other sites, including <br /> geologic materials or recycled asphalt/concrete <br /> 14. The operator is responsible for informing all persons associated with this project that <br /> they may be subject to prosecution for knowingly damaging, altering, excavating or <br /> removing any archaeological,historical, or vertebrate fossil objects or site. If <br /> archaeological,historical,Native American, or vertebrate fossil materials are discovered, <br /> the operator is to suspend all operations that further disturb such materials and <br /> immediately contact the Authorized Officer(AO). Operations are not to resume until <br /> written authorization to proceed is issued by the AO. The AO will evaluate, or will have <br /> evaluated, such discoveries not later than five (5)working days after being notified, and <br /> will determine what action shall be taken with respect to such discoveries.
