Findings and Resolution <br /> Stroh Pit Special Review- <br /> Page 8 <br /> Citizen comments, concerns and arguments,both written and verbal, have been <br /> given due consideration and found either to have been adequately addressed/mitigated by <br /> applicant and/or found not to be persuasive warranting a denial of the application. <br /> f The Applicant has demonstrated that this project can meet applicable <br /> additional criteria listed in Section 4.3 Use Descriptions. <br /> There are no special criteria or standards listed for mining. <br /> RESOLUTION <br /> WHEREAS, the Board of County Commissioners has made its findings upon the petition <br /> and upon the recommendation of the Larimer County Planning Commission,which findings <br /> precede this resolution. and by reference are incorporated herein and made a part hereof, and <br /> WHEREAS,the Board of County Commissioners has carefully considered the petition, <br /> evidence and testimony presented to it, and has given the same such weight as it in its discretion <br /> deems proper, and is now fully advised in the premises; <br /> NOW,THEREFORE, BE IT RESOLVED that the Coulson Excavating Company. Inc. <br /> (applicant and property owner) for a sand and gravel mining and processing operation generally <br /> known as the Stroh Pit upon the property described on Exhibit"A"be and the same hereby is <br /> granted upon the following conditions: <br /> 1. This Special Review approval shall automatically expire without a public hearing <br /> if the use is not commenced within three years of the date of this Findings and Resolution. <br /> 2. The Site shall be developed consistent with the approved plan and with the <br /> information contained in the Stroh Pit Special Review File#09-Z1771 except as modified by the <br /> conditions of approval or agreement of the County and applicant. The applicant shall be subject <br /> to all other verbal or written representations and commitments of record for the Stroh Pit Special <br /> Review. <br /> I Failure to comply with any conditions of the Special Review approval may result <br /> in reconsideration of the use and possible revocation of the approval by the Board of County <br /> Commissioners. <br /> 4. The County shall provide an initial draft Development Agreement for review and <br /> approval by the applicant prior to approval by the Board of County Commissioners. Board of <br /> County Commissioners approval of the Development Agreement shall occur no later than 90 <br /> days from the date on which this Findings and Resolution is approved by the Board of County <br /> Commissioners. <br />
