EXHIBIT L <br /> Reclamation Costs <br /> In order to calculate maximum potential reclamation liability to the State, we have selected a <br /> point in time where reclamation costs could be at a maximum. It is assumed that the time of <br /> maximum mining disturbance is when Phase 3 mining is complete. During this scenario, a <br /> portion of Phase 1 is being used for material stockpiles and processing, including operation of an <br /> asphalt plant. Phase 2 has been backfilled, compacted, graded, and revegetated with the <br /> originally approved seed mixture and Phase 3 is actively being backfilled. Topsoil/overburden <br /> stockpiles for backfilling will be near the pit and areas for reclamation, so haul distances will <br /> generally be less than 1,000 feet. Each disturbed area aspect is listed in the following table and <br /> illustrated on Figure L-1. Please refer to Exhibit D, Pre-Mining/Mining Plan, for a listing of <br /> disturbed areas that total 143.8 acres. This estimate will follow the same order as the listing in <br /> Exhibit D. Although over half of the total disturbed acreage is reclaimed with vegetation, the <br /> acreage is still considered disturbed since it has not been released from the MLRB reclamation <br /> permit. Connell Resources Inc. is an earth moving and construction contractor and unit costs for <br /> reclamation activities were provided from bidding documents associated with similar projects. <br /> Since all structures used in the mining operation are portable, it is assumed that removal of the <br /> structures do not have associated costs. <br /> The maximum disturbance scenario assumes that the Phase 3 mining area actively being mined <br /> will require backfilling (see Figure L-1, Aspect C-2). Some backfilling of the area will have <br /> already occurred to stabilize the mining highwall and side slopes, but it is assumed that the <br /> majority of backfilling is still required. Other aspects of the maximum disturbance scenario <br /> include: <br /> Phase 1 <br /> - Aspect Al mined area is being used for material processing and storage. Pit area will be <br /> backfilled to final grade. <br /> - Aspect A2 mined area is being used for material processing and storage. The pit area will <br /> include final construction of the below-grade reservoir liner. <br /> - Aspect A3 mined area has been mostly backfilled with compaction. The area will receive <br /> approximately two more feet of backfill for final grade. <br /> - Aspect A4 mined area includes recharge ponds and has been backfilled to create <br /> landscape/floodway diversion berms. The ponds and berms have been revegetated, but <br /> may require limited reseeding for final reclamation. The area also includes the pit bottom <br /> that will become the bottom of the below-grade reservoir. <br /> Phase 2 <br /> - Aspect B1 and B2 mined areas have been backfilled, compacted, graded, topsoiled, and <br /> seeded.
