Ewing Gravel Mine Substitute Water Supply Plan Page 4 of 7 <br /> March 25, 2024 <br /> The Hite Treatment Facility is located approximately 26 miles upstream of the Pit. The delivery schedule <br /> includes a transit loss of 0.5% per mile (13% for 26 miles) during the months of April through September <br /> and 0.25% per mile (6.5% for 26 miles) during the months of October through March. Conveyance loss for <br /> delivery of augmentation water to the South Platte River is subject to assessment and modification as <br /> determined by the Division Engineer. <br /> Total replacements during this SWSP period from the City of Aurora are 96.89 acre-feet. A summary of <br /> lagged depletions and replacements are provided on the attached lease. <br /> Long-Term Augmentation <br /> In accordance with the letter dated April 30, 2010 (attached) from the Colorado Division of Reclamation, <br /> Mining, and Safety ("DRMS"), all sand and gravel mining operators must comply with the requirements of <br /> the Colorado Reclamation Act and the Mineral Rules and Regulations for the protection of water <br /> resources. The April 30, 2010 letter from DRMS requires that the Applicant provide information to DRMS to <br /> demonstrate the ability to replace long term injurious stream depletions that result from mining related <br /> exposure of groundwater. The DRMS letter identifies four approaches to satisfy this requirement. In <br /> accordance with approach nos. 1 and 3, the Applicant has obtained a bond for $4,280,500 through the <br /> DRMS for complete reclamation of the site which, according to the DRMS permit, will require a complete <br /> backfill of the site. <br /> Conditions of Approval <br /> This SWSP is hereby approved in accordance with section 37-90-137(11), C.R.S., subject to the following <br /> conditions: <br /> 1. This SWSP shall be valid for the period of May 1, 2024 through December 31, 2025, unless <br /> otherwise revoked, or superseded by decree. A SWSP renewal request must be submitted to this <br /> office with the statutory fee (currently $257) by September 1, 2025. If a renewal request is <br /> received after the March 1, 2024 date, this plan may be considered a request for a new SWSP and <br /> the $1,593 filing fee will apply. <br /> 2. A well permit must be obtained for this pit in accordance with sections 37-90-137(2) and (11), <br /> C.R.S. prior to the exposure or use of groundwater. Well permit application (receipt no. 10033982) <br /> was submitted on January 26, 2024 and this application is pending evaluation. The provisions of <br /> section 37-90-137(2), C.R.S., prohibit the issuance of a permit for a well to be located within 600 <br /> feet of any existing well, unless the State Engineer finds that circumstances so warrant after a <br /> hearing held in accordance with the procedural rules in 2 CCR 402-5. This hearing may be waived <br /> if you are able to obtain statements from the owners of all wells within 600 feet, verifying that <br /> they have no objection to your use of the proposed well. Should a new well permit be denied for <br /> reasons of 600 foot spacing, or any other legitimate reason, approval of this substitute water <br /> supply plan will be canceled. <br /> 3. The total surface area of the groundwater exposed at the site during the period of this SWSP must <br /> not exceed the amounts shown on attached Table 1. <br />
