Reference is made to the 09CW 105 <br /> Decree for more detailed information. <br /> 5.4 The conditional groundwater rights described below. <br /> 6. Statement of Plan for Augmentation: <br /> 6.1 Evaporation from the exposed surface of the unlined gravel pits at the Dunn Site <br /> will be estimated monthly. <br /> 6.2 Depletions from the other augmented uses will be estimated monthly. <br /> 6.3 Out-of-priority depletions will be replaced by the sources of augmentation water <br /> identified herein. <br /> 6.4 The plan for augmentation will not cause any material injurious effect to the <br /> owner or user of any vested water rights or decreed conditional water rights. <br /> GROUNDWATER RIGHTS <br /> 7. Dunn Pits: <br /> 7.1 Location: Applicant currently plans for wet mining three unlined pits at the Dunn <br /> Site which will be located in the NE1/4 of Section 3, Township 4 North, Range <br /> 67W, and the SW1/4 of the SE1/4 of Section 34, Township 5 North, Range 67W <br /> of the 6th P.M., Weld County, as shown on the attached Exhibit A. The final <br /> number of unlined pits at this site may be more than the currently planned three <br /> unlined gravel pits but the total exposed surface area for pits at the Dunn Site <br /> shall not exceed the total exposed area identified in the plan for augmentation <br /> above. <br /> 7.2 Source of Water Right: Groundwater tributary to the Big Thompson River. <br /> 7.3 Uses: Reclamation, piscatorial, recreation, fish propagation and all uses associated <br /> with gravel and rock mining, including evaporation, dust suppression and <br /> production and processing losses, as well as replacement of evaporation from <br /> exposed groundwater at the Dunn Site as further described in the plan for <br /> augmentation above. <br /> 7.4 Appropriation Date: December 29, 2022. <br />
