Application of Loveland Ready-Mit Concrete,Inc <br /> Page 4 <br /> proceedings involving such rights,pursuant to Williams v. Midway <br /> Ranches, 938 P.2d 515 (Colo. 1997). Reference is made to the 09CW105 <br /> Decree for more detailed information. <br /> 5.2 Up to 200 acre-feet per year of fully consumable water leased by Applicant from <br /> the City of Loveland("Loveland") for augmentation use according to a lease with <br /> a 25 year term, with the option to renew for successive 25 year terms. In <br /> supplying the leased water, Loveland may use any water, including, but not <br /> limited to the following sources of water which may be used to extinction: <br /> 5.2.1 Native water from the Big Thompson River Basin which, when stored <br /> within Loveland's reservoir system, may be totally consumed pursuant to <br /> the terms and conditions of the decree in Case No. 82CW202A, Water <br /> Division 1; and <br /> 5.2.2 Water under an allotment contract with the Municipal Sub-District of the <br /> Northern Colorado Water Conservancy District, commonly known as <br /> Windy Gap Water; and <br /> 5.2.3 Any other water rights of Loveland determined by Water Court decree to <br /> be totally consumable. <br /> 5.3 LRM may use water for augmentation available under one or more of the <br /> conditional water rights for the Walters Reservoir Nos. 1 and 2 and/or the <br /> Bokelman Reservoir No. 1 ("Reservoirs") decreed in the 09CW105 Decree: <br /> 5.3.1 Decree Information: Originally decreed in Case No. 09CW105 on October <br /> 20, 2011. Diligence was found in Case No. 17CW3164 on August 21, <br /> 2018. <br /> 5.3.2 Description of Conditional Water Rights for the Reservoirs from the <br /> 09CW105 Decree: <br /> 5.3.2.1 Appropriation Date: December 18, 2007. <br /> 5.3.2.2 Source: Big Thompson River and water tributary to the Reservoirs. <br /> 5.3.2.3 Legal Descriptions: <br /> 5.3.2.3.1 Walters Reservoir No. 1 shall be located in the NE 1/4 of <br /> the SW1/4 of Section 24, Township 5 North, Range 68W of <br /> the 6th P.M., Larimer County as shown on Exhibit B. The <br /> approximate center of the reservoir is located 2083 feet <br /> from the south section line and 2034 feet from the west <br /> section line. <br />
