c) Section drawings that depict the as-constructed limits of <br /> excavation, final ground topography, configuration and geometry of the <br /> liner, and locations and contacts between fill zones of different materials <br /> that comprise the materials between the limits of excavation and the final <br /> surface of the slopes. <br /> d) Descriptions of material(s) that were used to construct the Cell side <br /> slopes and the liner. <br /> e) Results of the field and laboratory tests performed and daily <br /> observation reports. <br /> 0 Description of any modifications to the original design that occurred <br /> during installation. <br /> g) A volumelelevation-capacity table and curve for each cell. The <br /> table shall include the Storage volume at 9-foot intervals. <br /> vii. Any modifications to the liner or slope, remedial work to reduce seepage <br /> work or to correct substantial deficiencies, or penetrations of the liner that deviate <br /> from the approved plans shall be designed by a Colorado registered engineer <br /> and be submitted to Owner for review, comment, and approval at least sixty(60) <br /> days before the start of any such work. The design documents submitted to <br /> Owner shall include at a minimum (a) plan and section drawings that depict the <br /> proposed work, (b) technical specifications for the work, (c) other pertinent <br /> backup information used to prepare the design, and (d) calculations that provide <br /> an estimate of the effect on the steady state leakage rate into an empty pit after <br /> the work is completed and to the slope stability factor of safety and the seepage <br /> stability factor of safety. <br /> C. Jurisdictional Dam Issues. <br /> i. Contractor shall provide at least sixty (60) days notice to Owner prior to <br /> changing the topography on the Property so as to retain water above the <br /> elevation of the natural grade of the perimeter of the Reservoir that existed prior <br /> to mining. <br /> ii. Contractor shall provide least sixty (60) days notice to Owner prior to <br /> making any modifications that would require review by the SEO, Dam Safety <br /> Branch. <br /> iii. Prior to providing the notice to the Owner and to obtaining approval from <br /> the SEO, Contractor shall not place fill above the elevation of the natural ground <br /> surface that existed prior to the start of mining or make any modifications to the <br /> site that would require review and approval by the SEO, Dam Safety Branch. <br /> Construction Agreement—Zadel(v.4-24-08) <br /> 10 <br />
