Ground cover in the SP-2 Stock Pond consisted of 46.6% live vegetation, 0.6% rock, 6.2% litter, and <br /> bare ground exposure of 45.6%. Perennial cover across the unit averaged 13.8%, Temporary drainage <br /> control facilities are not subject to Rule 3.02.3(2) or Rule 3.03.1(2) as per Rule 3.03.1(5). <br /> C-15 Ditch <br /> The C-15 Ditch is 0.1 acres in size. The ditch was too small to include for vegetation sampling. <br /> Temporary drainage control facilities are not subject to Rule 3.02.3(2) or Rule 3.03.1(2) as per Rule <br /> 3.03.1(5). <br /> Topsoil replacement for the SP-2 Stock Pond and C-15 Ditch: <br /> Rule 4.06.4 does not apply to post-mining stock ponds and ditches. Therefore no topsoil replacement <br /> requirement was applied to the SP-2 Stock Pond or the C-15 Ditch. <br /> Sedimentology Results: <br /> SP-2 Stock Pond and C-15 Ditch <br /> Both the SP-2 Stock Pond and the C-15 Ditch are not required to have a sedimentology analysis <br /> conducted as there are no Rules applicable to post-mining stock ponds and ditches. <br /> Summary and Conclusions <br /> Based upon a review of the mine permit,the applicant's bond release application, and site inspections,the <br /> Division finds that Elk Ridge Mining and Reclamation, LLC has replaced topsoil in accordance with the <br /> approved reclamation plan. Elk Ridge Mining and Reclamation, LLC has established vegetation which <br /> supports the approved post mine land use and meets the approved success standard for vegetative cover. <br /> The Division finds that the reclaimed area subject to this bond release is not contributing suspended solids <br /> to streamflow or runoff outside the permit area in excess of premising levels or in excess of adjacent non- <br /> mined areas. <br /> PHASE III <br /> The post-mining land use for the SP-2 Stock Pond and the C-15 Ditch is to support dryland pastures. The C-15 <br /> Ditch will transport runoff to the SP-2 Stock Pond to provide water for livestock. The ditch was stable with no <br /> erosional concerns. There were no noxious weeds identified within the ditch or on the embankment. The ditch <br /> was functioning as designed and was supporting the post-mining land use. Temporary drainage control <br /> facilities are not subject to Rule 3.02.3(2) or Rule 3.03.1(2) as per Rule 3.03.1(5). <br /> The SP-2 Stock Pond was stable with no erosional concerns identified. The pond's embankment was <br /> covered with established vegetative growth. There were no noxious weeds identified within the pond, <br /> on the pond's inslopes, or on the pond's embankment. The pond was holding a small amount of water <br /> as designed and was supporting the post-mining land use.
