PHASE I <br /> One parcel was requested for Phase I release in the SL-26 application. The parcel consists of 0.1 acres associated <br /> with the C-15 Ditch,located in Section 36 north of Irrigated Pasture IP-8 and west of 2700 Road. The ditch was <br /> stable with no erosional features identified. The channel bottom was clear of debris and there was no evidence <br /> of down-cutting. The ditch's embankment was stable with vegetative cover. There were no indications of <br /> erosion or breaching of the embankment observed. The on the ground design of the C-15 Ditch matched the <br /> design parameters outlined in Attachment 2.05.3(3)-1 (P.5). The table on P. 5 of Attachment 2.05.3(3)-1 calls <br /> for the ditch to be 4 feet across and at least.44 feet deep. The channel was approximately 4 feet across and had <br /> a depth of at least.5 feet. Ditch D-15 was approved to remain as a permanent feature to support the SP-2 Pond, <br /> which will also remain as a permanent feature at the request of the landowner(Attachment 2.05.3(3)-17). <br /> Summary and Conclusions <br /> Based upon a review of the mine permit,the applicant's bond release application, and site inspections,the <br /> Division finds that Elk Ridge Mining and Reclamation, LLC has completed backfilling, grading and the <br /> establishment of the C-15 Ditch at the New Horizon Mine in accordance with the approved reclamation <br /> plan. <br /> PHASE II <br /> ERMR requested Phase II bond release on 2 parcels. <br /> The first parcel is 1.7 acres associated with the SP-2 Stock Pond (formerly Pond 009). SP-2 collects <br /> runoff from irrigated pastures upslope (IP-8). SP-2 had Phase I release approved under SL-25. SP-2 <br /> has functioned well as a stock pond in 2022 and 2023, and is not exhibiting significant rilling or <br /> gullying. Perennial vegetation has become established on the inslopes of the stock pond. In accordance <br /> with Rule 3.03.1(5)reclaimed temporary drainage control facilities,i.e. sediment ponds,are not subject <br /> to the extended liability period of 3.02.3(2). SP-2 is stable and blends in well with the surrounding <br /> slopes. SP-2 was approved by the Division of Water Resources to be a stock tank on November 4, <br /> 2019. SP-2 has an approved post-mining land use of a stock pond for a dryland pasture. <br /> The second parcel is 0.1 acres associated with the C-15 Ditch. The C-15 Ditch collects runoff from <br /> the upland irrigated pastures and transports the runoff to the SP-2 Stock Pond. The C-15 Ditch has <br /> functioned well for this purpose. The ditch was stable with no indications of erosional features. There <br /> were no observations of down-cutting in the channel or runoff escaping from the ditch.
