2023-2024 Valley's Edge Resource Substitute Water Supply Plan Renewal Page 3 of 6 <br /> November 16, 2023 <br /> will be owed at the location where the South Platte River crosses the north line of the SE '/a of the <br /> NW'/a of Section 19. <br /> Replacements <br /> Out-of-priority depletions from the Valley's Edge Resource Gravel Mine will be replaced using 58.78 <br /> acre-feet of fully consumable municipal return flows leased from the City of Aurora. The <br /> replacement is provided through the attached renewable lease dated March 7, 2017 renewed on <br /> October 20, 2023. The lease can be renewed for one-year period through October 31, 2028. If <br /> actual depletions are greater than projected depletions in any month, the amount of replacement <br /> water required from the City of Aurora may exceed the agreed upon volume. The Applicant is <br /> responsible for assuring that adequate replacement volume is provided. <br /> Under the lease, water will be delivered to the outfall of the Robert W. Hite Treatment Facility <br /> (aka Metro Sewer, WDID 0200700) located in Denver, CO on the South Platte River. According to <br /> the lease, Aurora may alternatively deliver water at other points along a reach of the South Platte <br /> River beginning at or below the Hite Treatment Facility extending downstream to the confluence of <br /> the St. Vrain River and the South Platte River above the point of depletion in the SE'/a of the NW'/a <br /> of Section 19. The Applicant must notify the Water Commissioner at least 48 hours prior to making <br /> replacement deliveries at a location other than the Hite Treatment Facility. In the instance of an <br /> intervening call, the Applicant will not be allowed to make replacements downstream of the <br /> calling right. <br /> The Hite Treatment Facility is located approximately 22 miles upstream of the Pit. The delivery <br /> schedule includes a transit loss of 0.5% per mile (11% for 22 miles) duringthe monthsof April through <br /> October and 0.25% per mile (5.5% for 22 miles) during the months of November through March. <br /> Conveyance loss for delivery of augmentation water to the South Platte River is subject to <br /> assessment and modification as determined by the Division Engineer. <br /> Conditions of Approval <br /> I hereby approve the proposed SWSP in accordance with section 37-90-137(11), C.R.S. subject to <br /> the following conditions: <br /> 1. This SWSP is approved with the effective date of November 1, 2023 through October 31, <br /> 2024, unless otherwise revoked or superseded by decree. If this plan is not decreed in water <br /> court by the SWSP expiration date, a renewal request must be submitted to this office <br /> with the statutory fee of $257 no later than August 1, 2024. If a renewal request is <br /> received after the expiration date of this plan, it will be considered a request for a new <br /> SWSP and the $1593 filing fee will apply. <br /> 2. Approval of this SWSP is for the purposes stated herein. Additional uses for the water that <br /> is the subject of this SWSP will be allowed only if a new SWSP is approved for those additional <br /> uses. <br /> 3. Well Permit 82057-F has been issued for this pit, and this permit remains valid. The permit <br /> covers up to 30 acres of exposed surface area and allows for annual water uses of up to <br /> 118.23 acre-feet for evaporation losses,water lost with the mined product, and dust control. <br /> Actual depletions cannot exceed these amounts and are limited to those uses specifically <br /> approved through this SWSP. <br /> 4. The total surface area of the groundwater exposed at the Valley's Edge Resource Gravel Mine <br /> must not exceed the area shown on attached Table 1 during this SWSP approval period, which <br />
