The operator agreed to repair the rills (DRMS has their locations) and to continue to monitor the
weeds and provide control measures when appropriate.
In addition to the bond release parcels, the group toured the Juniper Pit where DRMS issued a
Cessation Order (CO-2023-001) and Notice of Violation (CV-2023-001) in June of 2023 because
TMI was found to be grubbing and preparing for a blast in an area not yet approved for
disturbance. TMI had proposed this area for disturbance within Technical Revision 134, but it
had yet to be approved by DRMS at the time of violation. DRMS approved the revision on
August 1, 2023, and the cessation order and violation were terminated on August 4, 2023. No
issues were noted with the area at the time of inspection (Figure 6).
Conclusion
Overall the site was stable but required a few repairs to eliminate rills on the lands associated
with the Phase II bond release application. No enforcement actions were taken in response to this
inspection, nor are any pending.
