<br /> management treatment, storage, disposal or Release of Hazardous Materials into
<br /> the Environment, including the Atomic Energy Act, the Uranium Mill Tailings
<br /> Radiation Control Act, the Comprehensive Environmental Response,
<br /> Compensation and Liability Act, the Clean Air Act, the Clean Water Act, the
<br /> Solid Wastes Disposal Act (as amended by the Resource Conservation and
<br /> Recovery Act), theL'oxic Substances Control Act, Emergency Planning and
<br /> Community Right to Know Act, the Safe Drinking Water Act,the General Mining
<br /> Law and the Federal Land Policy and Management Act, any state or local
<br /> counterparts to such statutes,any regulations,orders or findings issued under any
<br /> of such statutes, and any similar Laws of any other Governmental Entity,and any
<br /> other Laws of any Governmental Entity to the extent relating to reclamation of
<br /> lands affected by mining or any provisions of permits;
<br /> (f) "Environmental Liabilities" means any and all Losses of any kind or nature
<br /> arising out of, based on, resulting from or alleging (a) the presence, Release or
<br /> threatened Release,of any Hazardous Materials existing or arising on,beneath or
<br /> above any of the Leases & Claims, including Claims with respect to other
<br /> properties based upon Claims relating to the Release or threatened Release of
<br /> Hazardous Materials from the Leases&Claims to such other properties,whether
<br /> or not immediately adjacent to the property, (b) the violation of any
<br /> Environmental Laws involving any of the Leases & Claims, including Claims
<br /> with respect to other properties based upon Claims relating to the Release or
<br /> threatened Release of Hazardous Materials from the subject property to such
<br /> other properties, whether or not immediately adjacent to the property or (c)
<br /> Claims by private (non-governmental) parties for natural resources damages,
<br /> penalties or fines,or property damages or personal injuries;
<br /> (g) "Governmental Entity" means any foreign or domestic (a) nation, state,
<br /> province, territory, municipality, or other political subdivision of any nature, (b)
<br /> federal, state, provincial, territorial, local, municipal, or other government,
<br /> governmental, or quasi governmental authority of any nature (including any
<br /> governmental agency, branch, bureau, central bank, commission, department,
<br /> ministry, official, or entity and any court, board or other tribunal) or (c) body
<br /> exercising, or entitled to exercise, any administrative, executive, judicial,
<br /> legislative,police,regulatory,or taxing authority or power of any nature;
<br /> (h) "Hazardous Material" means any waste or other substance that is listed,
<br /> defined, designated, or classified as, or otherwise determined to be, hazardous,
<br /> radioactive, or toxic or a pollutant or a contaminant under or pursuant to any
<br /> Environmental Law,including any mixture or solution thereof;
<br /> (i) "Law" means any applicable statute, rule, code, regulation, by law,
<br /> interpretation, ordinance,judgment or order of, or issued by, any Governmental
<br /> Entity;
<br /> {j) "Liabilities" means any liabilities (including Environmental Liabilities),
<br /> obligations, guaranties, debts, commitments or undertakings, of any nature,
<br /> whether known or unknown, express or implied, accrued, liquidated, absolute,
<br /> contingent or otherwise,and whether due or to become due;
