Notice was provided to the subscribers <br />to the Water Division 2 SWSP notification list on January 3, 2020. There are no opposers in <br />Case No. 19CW3062. No comments were submitted within the statutory 35-day comment <br />period. The $300 filing fee has been paid and given receipt no. 3696240. <br />The initial date of approval for this SWSP was February 22, 2016 for operation beginning <br />March 1, 2016. Pursuant to 9 37-92-308(4)(b), C.R.S., "if an applicant requests renewal of a <br />plan that would extend the plan past five years from the initial date of approval, the <br />applicant shall demonstrate to the water judge in the applicable water division that the delay <br />in obtaining a decree has been justifiable and that not being able to continue operating under <br />a substitute water supply plan until a decree is entered will cause undue hardship to the <br />applicant." This is the fifth year of approval of this SWSP. <br />WITLAZOU-4 16 <br />Clevenger Red Creek System, WDID 1402067 (previously known as WDID 1202272), is a spring <br />located in the SE 1/4 of the NE 1/4, Section 34, Township 20 South, Range 68 West, Sixth P.M., <br />and was originally decreed by the Division 2 Water Court in case no. W-0059. The water right <br />is decreed for 0.011 cubic feet per second for stock water and for domestic use.
