0010 <br /> General Shale <br /> Building The American Dream® <br /> Problem 2 General Compliance With Reclamation Plan <br /> Failure to follow approved reclamation plan, or current reclamation plan needs to be updated and <br /> clarified pursuant to C.R.S. 34-32.5-116 and Rule 6.4.5. The operator must follow approved reclamation <br /> plan or provide sufficient information to describe or identify how the operator intends to conduct <br /> reclamation. Specifically, the reclamation plan needs to be updated to describe how stormwater <br /> management structures at the site (e.g., ditches, rock check dams, pond) will be reclaimed. If any of <br /> the stormwater management structures are proposed to remain for reclamation, or any other changes <br /> are proposed in the updated reclamation plan, the revision must also include an updated reclamation <br /> plan map that meets the requirements of Rules 6.2.1(2) and 6.4.6. The operator should be advised, <br /> any proposal to leave a structure for reclamation must include a notarized letter from the landowner <br /> acknowledging their desire to leave such structure. <br /> (a) A description of the type(s) of reclamation the Operator/Applicant proposes to achieve in <br /> the reclamation of the affected land, why each was chosen, the amount of acreage <br /> accorded to each, and a general discussion of methods of reclamation as related to the <br /> mechanics of earthmoving; <br /> Add water trucks, motor graders, excavators, and trucks to the list of mining equipment. <br /> (b)A comparison of the proposed post-mining land use to other land uses in the vicinity and <br /> to adopted state and local land use plans and programs. In those instances where the <br /> post-mining land use is for industrial, residential, or commercial purposes and such use <br /> is not reasonably assured, a plan for revegetation shall be submitted. Appropriate <br /> evidence supporting such reasonable assurance shall be submitted; <br /> No Change <br /> (c) A description of how the Reclamation Plan will be implemented to meet each applicable <br /> requirement of Rule 3.1; <br /> a. Reclamation Measures - Materials Handling <br /> 1. Grading <br /> The waste brick stockpile and check dams will be placed in the pit during final <br /> reclamation. The waste brick will be mixed with overburden material will be placed <br /> in 1'-2' lifts, watered (if necessary) and compacted using available mining <br /> equipment. <br /> The final slope grade in the reclamation plan is 3:1. However in the reclamation plan <br /> map the slope is 4:1 slope. To clarify this contradiction a 3:1 slope will be used for <br /> the reclamation slope. <br /> b. Water - General Requirements <br /> i. Hydrology and Water Quality: <br /> The pit intersected groundwater and more information is found in Exhibit G Water <br /> Information. An application was filled and approved on February 12, 2007 by the <br /> Colorado Groundwater Commission to construct as well and appropriate ground <br /> water in the Kiowa-B#ou designated ground water basin permit number 65324-F. <br /> ii. Earth dams <br /> The existing livestock pond will be backfilled and reclaimed during final <br /> reclamation. A new livestock pond will be built to the west to better align with <br /> existing natural drainage. A change of location will be filed with the Division of <br /> water resources when the livestock pond is rebuilt to the west. A livestock water <br /> tank was approved by the Division of Water Resources. <br />
