AA MW Sorter <br /> September 1, 2023 <br /> Elliott Russell <br /> Environmental Protection Specialist <br /> Department of Reclamation, Mining and Safety <br /> 1313 Sherman Street, Room 215 <br /> Denver, CO 80203 <br /> Re: Adequacy Review Response; M-2023-015 <br /> London Mine, File No. M-2023-015 <br /> Dear Mr. Russell, <br /> Representatives from MW Sorter (MineWater) have carefully reviewed your Adequacy Review Letter <br /> dated August 25, 2023 and wish to submit the following updated Exhibits with additional information to <br /> address any concerns or add requested details to the previously submitted 110d package. <br /> AFFECTED LANDS BOUNDARY—HAUL ROAD <br /> DRMS(Item#IA):To proceed with the application as proposed, the Applicant may submit an Amendment <br /> to the Application to revise the Affected Lands Boundary to include haul roads... <br /> MW Sorter(Item#IA Response): Please see the updated Exhibit E Mining Plan Map which includes the <br /> road to be used for hauling waste rock to the processing area and waste/fines back to the South London <br /> Stockpile Area for final disposal. Please note that County Road 696 exists between the two disturbance <br /> areas and will be used accordingly. Additional sections of private roads, owned and maintained by MW <br /> Sorter, have been identified within Exhibit E. <br /> DRMS(Item#IB)e-mail from Elliott Russell(DBMS)at 3:39pm on August 28: <br /> Applicant may move forward with submitting an amendment to only include the Non-County portions of <br /> the haul road(ie the portions of the road from the fork up to the South London Stockpile and also from the <br /> Central Extension Area over to the County Road will both need to be included in the permit, with the <br /> approx. 112 mile of County Road 696 excluded). With this, you will need to submit: <br /> 1. Documentation from the County which shows their ownership of the road: Please see e-mail <br /> from Greg Kasparek (County ROW Manager)—Appendix A at the end of this letter. <br /> 2. An approval/agreement which allows the haulage of material with heavy equipment on the <br /> road and any discussion regarding maintenance and repair: Please see e-mail from County <br /> including map for Gate placement—Appendix A at the end of this letter. <br /> 3. A safety plan for the public: See response 1B below for details, and <br /> 4. A monitoring and clean-up plan to ensure no waste rock in transport to the processing area nor <br /> waste rock/mineralized fines in transport for disposal is spilled and left on the county road. See <br /> response 1B below for details. <br /> MW Sorter(Item#1B Response): MineWater has updated the Affected Lands Boundary in Exhibit E <br /> Mining Plan Map to provide for the area of two-way haulage roads not otherwise managed by the <br /> County to be in the Affected Lands Boundary. <br /> 1 Page <br />
