AA <br /> MW Sorter <br /> MineWater has also documented the County Right of Way position relative to the ownership of the <br /> County Road 696 in the attached Appendix A e-mail from Park County. <br /> Safety and Road Maintenance Plan-MineWater is also including with this submittal a commitment to <br /> conduct daily inspections of the roadway (both in the affected lands boundary, and on the County <br /> Section of the roadway) to ensure that if mineralized materials are spilled, MineWater personnel will <br /> clean-up the spill within no more than 24 hours. MineWater also commits that, if there are repeated <br /> issues with spillage, identify and implement corrective actions including repair of items such as uneven <br /> roadways,or excessive filling of haul trucks,to reduce the incidence of spills. <br /> MineWater will also evaluate if tracking of fines is occurring and will implement a track pad system for <br /> the trucks to drive across to reduce tracked materials leaving the Site onto the County Road. MineWater <br /> has also committed to develop a plan to provide for public safety, including enhanced warning signage, <br /> flashing yellow lights on all haul trucks, radio contact among all haul truck drivers during hours of <br /> operation with immediate notification between drivers of approved light vehicle traffic within the <br /> haulage area, and maintenance of 5 existing turnouts along the portion of the County Road (Rome <br /> Junction, before first switchback, uphill of second switchback, London Fault crossing, and the Crest of <br /> Hill) to allow haul trucks, as quickly as approved visitors are noted, to yield the right-of-way to such <br /> visitor traffic. <br /> GENERAL APPLICATION PRODEDURES <br /> DRMS(Item#2):As required by Rule 1.6.2(1)(g), please submit proof of publication of a public notice in a <br /> newspaper of general circulation in the locality of the proposed mining operation. Proof of publication <br /> received August 2, 023 is adequate. No response needed. <br /> MW Sorter(Item#2 Response): MineWater notes that the Division requirement for an Amendment due to <br /> the Haul Road inclusion will require publication which will now occur on September Sth,2023 if authorization <br /> to publish is timely received before the publication date. Final proof of publication will be provided at a <br /> later date. Appendix F at the end of this letter is the approved public notice. <br /> DRMS(Item#3A):As required by Rule 1.6.2(1)(g),please submit proof that the public notice was provided <br /> to all owners of record of surface and mineral rights of the affected land and to the owners of record of all <br /> land surface within 200 feet of the boundary of the affected land. Proof of notice may be return receipts <br /> of a certified mailing or by proof of personal service. Proof of noticing MW Sorter LLC and MineWater <br /> Finance LLC received August 9, 2023 is adequate. <br /> MW Sorter(Item#3A Response): Applicant will provide notarized statements from MW Sorter LLC and <br /> MineWater Finance acknowledging receipt of the reissued Public Notice. <br /> DRMS(Item#38): Upon review of the Park County Assessor online map viewer, the United States Forest <br /> Service appears to be a surface owner within 200 feet of the Central Extension and Sorting Plant Area and <br /> it appears three other owners share ownership with MineWater Finance LLC on Parcel/Schedule <br /> #R0090417 located within 200 feet of the South London Stockpile Area. These additional surface owners <br /> will need to receive notice in accordance with Rule 1.6.2(1)(g) and be given their own personal 10-day <br /> comment period. <br /> 2 1 P a g e <br />
