physical, climatological, and other characteristics of the site, and will conform to the
impoundment performance factor of safety of 1.3 (4.05.6(l 1)).
E. Acid-forming and Toxic-forming Spoil
The Division approved temporary storage of acid-and toxic-forming spoil for more than
30 days. This decision was based on a finding that burial or treatment of these materials
within 30 days was not feasible and the delay would not result in any material risk of
water pollution or other environmental damage (4.05.8(3)). See Section 2.04.6 for
identification, mining plan contingencies, and spoil/mine soil reconstruction plans
(respectively) that address acid or toxic spoil horizons.
F. Impoundments
All impoundments have been designed to meet the applicable requirements of Section
4.05.9.
G. Surface and Ground Water Monitoring
1. The applicant will conduct monitoring of ground water in a manner approved by
the Division (4.05.13(1)). Surface and ground water monitoring station locations
are shown on map 2.04.7-1-A in the permit. The ground water monitoring plan is
as follows:
a) The current ground water monitoring network consists of 6 monitor wells.
b) All wells in the area will be monitored quarterly for water levels adjusted to
MSL and samples will be collected on a quarterly basis for water quality
parameters.
2. The applicant will conduct monitoring of surface water in a manner approved by
the Division. The monitoring plan was submitted under 2.05.6(3)(b)(iii) and
includes the following: (4.05.3(2))
a) The current surface water monitoring program consists of quarterly field
parameters and quarterly laboratory parameters.
c) NPDES sites (sediment pond outlets) will be monitored according to the
CDPS permit.
H. Stream Buffer Zones
The Division has approved a variance for disturbance within designated stream buffer
zones for Tuttle Draw, Calamity Draw and Enstrom Draw. The variances were
discussed and approved with TR-83.
24
