Chavers Mining Resources Substitute Water Supply Plan 2023 Page 5 of 8 <br /> August 29, 2023 <br /> a. total surface area of the groundwater exposed at the Chavers Mining Resources site must not <br /> exceed 18 acres, which results in an annual evaporative loss of 48.68 acre-feet per year and <br /> 18.47 acre acre-feet for the period of August 1, 2023 through December 31, 2023; <br /> b. the water used for dust control at the Chavers Mining Resources site shall not exceed 1.25 <br /> acre-feet per year and 0.52 acre-feet for the period of August 1, 2023 through December 31, <br /> 2023; <br /> c. the total product mined at the Chavers Mining Resources site shall not exceed 650,000 tons per <br /> year and 261,000 tons during the August 1, 2023 through December 31, 2023, which results in <br /> 19.12 acre-feet per year of water lost with the mined aggregate and 7.69 acre-feet for the <br /> period of August 1, 2023 through December 31, 2023; <br /> d. the total concrete production shall not exceed 154,000 cubic yards per year and 68,190 cubic <br /> yards during the August 1, 2023 through December 31, 2023, which results in 14.18 acre-feet <br /> per year of water used for concrete production and 6.28 acre-feet for the period of August 1, <br /> 2023 through December 31, 2023; and <br /> e. total consumption at the Chavers Mining Resources site must not exceed these aforementioned <br /> amounts unless an amendment is made to this SWSP. <br /> 3. The Applicant must replace all out-of-priority depletions resulting from operation under this SWSP, <br /> including those lagged depletions that occur to the stream after the expiration date of this SWSP. <br /> 4. As part of any renewal of this SWSP, the Applicant must specify the proposed replacement source that <br /> will be used to replace all lagged depletions that result from operation under this SWSP, including <br /> those that extend beyond the approval period of the SWSP. If the intent is to obtain a short term <br /> lease for such future replacement water an executed lease for depletions that extend beyond the <br /> SWSP approval period is not required, however the Applicant must demonstrate that there is a <br /> reasonable likelihood that such a lease could be obtained. <br /> 5. Approval of this SWSP is for the purposes as stated herein. This office must first approve any <br /> additional uses for the water. <br /> 6. All pumping for dust control shall be measured in a manner acceptable to the Division Engineer. <br /> 7. Well permit no. 80121-F was issued for the gravel pit site in accordance with sections 37-90-137(2) <br /> and (11), C.R.S. and this permit remains valid. Well permit no. 80120-F was issued in accordance with <br /> section 37-90-137(2), C.R.S. for the alluvial well used for the concrete production, and this permit <br /> remains valid. <br /> 8. The replacement water that is the subject of this SWSP cannot be sold or leased to any other entity. <br /> As a condition of subsequent renewals of this SWSP, the replacement water must be appurtenant to <br /> this site until a plan for augmentation is obtained. All replacement water must be concurrent with <br /> depletions in quantity, timing, and locations. <br /> 9. The Applicant shall provide daily accounting (including, but not limited to diversions, depletions, <br /> replacement sources, and river calls) on a monthly basis. The accounting must be uploaded to the <br /> CDSS Online Reporting Tool within 30 days of the end of the month for which the accounting applies <br /> (https://dwr.state.co.us/Tools/reporting). Instructions for using the tool are available on the Division <br /> of Water Resources website on the "Services" —> "Data Et Information" page under the heading of <br /> Online Data Submittal. Accounting and reporting procedures are subject to approval and modification <br /> by the division engineer. Accounting forms need to identify the WDID number for each structure <br /> operating under this SWSP. Additional information regarding accounting requirements can be found in <br /> the attached Augmentation Plan Accounting Administration Protocol for Division One. NOTE: Monthly <br /> accounting, even during the winter non-irrigation season, is required. <br />
