The remaining disturbed area <br /> will be reclaimed as upland meadows; <br /> ii. There shall be a minimum loo-foot mining setback from St. <br /> Vrain Creek, except that the setback in the area of the Eagle <br /> Roost shall be as shown on Exhibit M; <br /> iii. Inflows to the wetlands or ponds will be from indirect <br /> groundwater flow; water from the Coffin-Davis and Bonus <br /> Ditches. The system will discharge to St. Vrain Creek from <br /> the Boulder Creek Estates Pond by a sufficient discharge <br /> structure to be constructed by Aggregate. <br /> d. Reclamation Timing. Aggregate shall progressively or concurrently <br /> reclaim areas where mining has been completed, except for the <br /> planned discharge of aggregate fines from Aggregate's processing <br /> plant on the Distel Option Property. Aggregate shall use such <br /> aggregate fines for this purpose as are available from its mining <br /> operations on the Combined Properties, the Tull Property and the <br /> Irwin/Thomas mine. <br /> i. Landfill and Distel Option Properties. Mining has been <br /> completed on the Distel Option Property and mining shall be <br /> completed on the Landfill Property by September 30, 2011, <br /> and the reclamation of slopes shall be completed by <br /> December 31, 2013. The ponds on both properties shall be <br /> used by Aggregate to store mining fines from the <br /> Irwin/Thomas and Tull Properties. During this period of <br /> storage of fines and reclamation, Aggregate shall maintain a <br /> continuous flow of water, subject to intermittent <br /> interruptions related to ongoing mining operations from the <br /> Combined Properties through the pond in Boulder Creek <br /> Estates Pond to St. Vrain Creek so long as mining operations <br /> are underway. <br /> (a) The backfilling of the Landfill and Distel Option <br /> Properties with aggregate fines as shown on Exhibit L <br /> (GEI DRAWINGS) may continue until December 31, <br /> 2028, with Aggregate taking the necessary steps to <br /> allow the construction and use of the St. Vrain <br /> Greenway. <br /> (b) Options for one-year extensions to December 31, 2031 <br /> shall be granted subject to Subsection e. of this <br /> Section 29. <br /> Page 11 of 32 <br /> Aggregate Industries <br /> Final <br />
