A site specific development plan and amended use by special <br /> review permit (AMUSR # 877) as evidenced by Weld County <br /> Resolution 2001-02o6 PLo687 on January 31, 2001, for the <br /> integrated mining and reclamation of the Combined <br /> Properties, Distel Option Property, and other properties. <br /> ii. The State of Colorado Division of Minerals and Geology <br /> approval, on December 20, 2000, of an amended Permit No. <br /> M-1989-029, Revision No. AM-3, for such integrated mining <br /> and reclamation, and the Division's approval on April 17, <br /> 2001 of a succession of operators from CAMAS Colorado, <br /> Inc.to Aggregate for this operation. <br /> iii. The State of Colorado Division of Reclamation, Mining and <br /> Safety approval on November 23, 2004 of a technical <br /> revision to Permit No. M-1989-029, TR-4 for the revised <br /> reclamation plan as agreed upon by Longmont and <br /> Aggregate in the First Amendment to Amended and Restated <br /> Lease. <br /> b. Description of Plan. The Integrated Plan is described in detail in <br /> the application submitted by Aggregate ("Permit Application") for <br /> its county and state permits identified above, and this application <br /> submittal is entitled "Longmont Distel Operations, Weld County, <br /> Colorado; Application for Amendment to Regular 112 Permit for <br /> Construction Materials and Weld County Use by Special Review <br /> Permit," dated September 20, 200o, and was prepared by Steffen <br /> Robertson and Kirsten (US), Inc. The revised Integrated Plan is <br /> described in detail in the technical revision request (TR-4) <br /> submittal to the state permit and subsequent responses to the <br /> State's technical adequacy review documents as prepared by Hart <br /> Environmental. The revised Integrated Plan is depicted on a map <br /> designated as Reclamation Plan Exhibit Fa, revision date August <br /> 25, 2004, in the Permit TR-4, and is attached as Exhibit K hereto <br /> and incorporated herein. This Plan decreased the area of mined-out <br /> ponds and reduced water lost to evaporation, and it also increased <br /> the variety of terrain,vegetation and wildlife habitat. <br /> C. Plan Requirements. By this Second Amended Lease the parties <br /> agree to additional modifications to the Integrated Plan as follows: <br /> i. As shown on Exhibit L, Conceptual Site Reclamation Plan <br /> drawings dated May, 20o9, as prepared by GEI Consultants, <br /> reclamation of the Combined Properties shall create eight(8) <br /> ponds totaling approximately 59.8 acres, lowland/wetland <br /> areas totaling approximately 27.4 acres, all along a single <br /> Page 10 of 32 <br /> Aggregate Industries <br /> Final <br />
