Stipulation No. 64: This stipulation was attached to the permit through TR-67, <br /> approved on November 13, 2009. Twentymile Coal is approved to construct the <br /> Refuse Disposal Area Expansion in accordance with designs approved in Technical <br /> Revision No. 67. Twentymile Coal Company requested to provide bond for the <br /> increased disturbance area in three increments. The first increment, "Initial Bonded <br /> Disturbance" of 50.0 acres, is limited to construction of 30.3 acres of refuse pile <br /> expansion, 2.4 acres of haul road corridor, 5.9 acres of unclassified stockpile, 3.5 acres <br /> of topsoil stockpile, .04 acres of stockpile haul corridors, and 7.5 acres of construction <br /> of RDA10 and RDA11 ditches, as shown on Map C-102 (11/13/2009). Prior to <br /> disturbance of the Refuse Disposal Disturbance, Twentymile Coal is required to <br /> submit additional bond adequate for disturbances associated with bonding increments I <br /> and 11. No disturbance associated with bonding increments I and II shall occur prior to <br /> submittal and Division approval of additional bond. <br /> The current progress of the RDA Expansion does not extend beyond the originally <br /> delineated Phase I area. TC will begin the extension of the underdrain and construct <br /> additional temporary perimeter collection ditches in conjunction with the initiation of <br /> Phase 11 of the RDA Expansion. Phase II will involve an additional 30 acres of <br /> disturbance for the Phase II footprint and soil removal buffer zone. All bonding costs <br /> associated with the Phase 11 expansion have been incorporated in the RN-06 cost <br /> estimate. The information associated with Stipulation No. 64 has been incorporated <br /> into the PAP. <br /> IX. Coal Mine Waste—Rule 4.11 <br /> The Coal Mine Waste Fire Fighting Plan is found in Exhibit 25a of the permit(4.11.1). <br /> Twentymile Coal Company has previously been approved to dispose of select non- <br /> coal waste in a location south of the Area 1 pit. This location is located in spoil <br /> material from the Energy Mine No. 1, and is located above the water table (4.11.4(1)- <br /> (3)). In addition, coarse coal processing waste is placed in the coal mine waste bank. <br /> Coal processing waste fines are placed in the coal mine waste bank or returned <br /> (thickener underflow)to abandoned workings in the Southwest Mining District or <br /> Eastern Mining District. <br /> No coal mine wastes are stored at the Fish Creek Tipple (4.11.3). <br /> X. Backfilling and Grading <br /> The Foidel Creek mine portals are located along Foidel Creek, faced-up in the <br /> highwall from the adjacent surface mining activity in Eckman Park. Partial backfilling <br /> and grading was done to help seal the portal area from groundwater inflow. The <br /> remaining backfilling and grading will occur at the completion of mining activity at <br /> the Foidel Creek mine. No specific approvals are granted under this section. <br /> XI.
