Upon cessation of mining activities, all surface disturbances will be reclaimed. Surface facilities <br /> will be removed. The portal area, Area 2 pit and the waste disposal site will be backfilled with <br /> previously mined spoils existing within areas adjoining the old Energy No. 1 pit. All surface <br /> disturbances will be regraded to approximate original contour. Topsoil from existing and <br /> proposed topsoil stockpiles will be redistributed over the entire disturbed area to depths 0.7 feet <br /> to 0.8 feet as depicted on Map 29 of the permit application, with the exception of those piles <br /> which are dedicated to specific areas from which it was removed. Re-seeding and revegetation <br /> will occur following topsoil laydown operations. Reclamation success will be determined by <br /> statistically comparing the reclaimed areas to reference areas, except at the Fish Creek Tipple, <br /> which was constructed prior to implementation of the current laws and regulations. <br /> Findings of the Colorado Division of Reclamation, Mining, and Safety <br /> for the Foidel Creek Mine <br /> Information Source and Order of Findings <br /> These findings are based on information made available to the Division that demonstrates the <br /> applicant will be able to operate in compliance with the Colorado Surface Coal Mining <br /> Reclamation Act and the Regulations promulgated pursuant to the Act. As explained in the <br /> preceding section titled Introduction, various state laws require that these findings be made prior <br /> to approval of a permit renewal or revision. <br /> The findings which are required by Section 2.07.6(2) of the Regulations are listed in the same <br /> order as they are listed in that Section. The findings and specific approvals required by Section <br /> 2.07.6(2)(m) and Rule 4 are listed in the same order as they are listed in Rule 4, and are <br /> organized under subject or discipline subtitles. <br /> These findings were reevaluated and updated from the previous findings document to reflect <br /> changes which have occurred during the past permit term. Any stipulations from the original <br /> permit and findings document or subsequent revisions that have been totally resolved to the <br /> satisfaction of the Division have been removed from this document. <br /> Stipulations <br /> Stipulations are a binding part of the permit and previously assigned stipulation numbers cannot <br /> be re-used. No stipulations are being proposed in conjunction with this renewal application (RN- <br /> 08). No stipulations have been removed since the previous midterm review (MT-08). <br /> The permit has one active stipulation, ST67, which states that the operator must complete the <br /> supplemental cultural resource survey for the expansion of panel 7 Right LW Panel 3 (7 East <br /> Panel)to satisfy the concerns/obligations of the Office of Archaeology and Historic Preservation <br /> prior to longwall mining in the affected area. The survey must be submitted to the Division in <br /> the form of a Minor Revision (MR)to be incorporated into the PAP prior to beginning longwall <br /> mining.
