EXHIBIT E RECLAMATION PLAN(CONT) <br /> There are no acid-forming or toxic materials inherent in the sand <br /> and gravel deposit . <br /> If petroleum products are stored at the site for mining equipment <br /> and operations, they will be stored as prescribed by applicable laws . <br /> Any storage tanks will be surrounded by a berm or be of the latest <br /> multi-wall construction, adequate to contain any fluid spilled, <br /> should a tank rupture . In addition, there is adequate absorbent <br /> materials on site to contain any spills that would occur. <br /> There ac e- n e Eliarl e is ruefe� hiTre ss en crtit e 1-a.- <br /> Maximum slopes within the mined area will be within the limits <br /> set forth in the Rules and Regulations of the Board and will be capable <br /> of being traversed by machinery. The slopes between the eastern and <br /> western reservoirs will remain undisturbed and in their natural <br /> state, slope and appearance . <br /> The operator does not expect prevailing hydrologic conditions <br /> to be disturbed. L.G. Everist will comply with applicable Colorado <br /> water laws and regulations (as the operator understands them) which <br /> govern existing water rights . The operator does not expect to <br /> adversely affect the prevailing hydrologic balance of the affected <br /> land and surrounding areas . Nor does the operator expect to affect <br /> the quality of water in surface and ground-water systems both during <br /> and after the mining operation and during reclamation. In addition, <br /> the operator shall comply with applicable Federal and Colorado water <br /> quality laws and regulations . Any water used in the mining operation <br /> and the processing plants will come from water owned or leased by L.G. <br /> Everist and legally suitable for use in mining operations . EXHIBIT <br /> G - WATER INFORMATION contains specific information concerning impacts and <br /> uses of water at this mining operation. A Groundwater Model and Water <br /> Quality Monitoring plan are included in Exhibit G - Water. <br /> No dredging takes place at this facility, there are no temporary <br /> siltation structures involved in this operation and no mining will <br /> be done in a river or waters of the United States . A U. S . Army Corps <br /> of Engineers 404 Permit is not required for this operation because <br /> there are no jurisdictional wetlands on the site . The operator has <br /> been approved for a RGP-5 from the Corps for the relocation of 1 <br /> irrigation return flow ditch in Phase 1, along the eastern side of <br /> the phase. A copy of the JD and RP5 are included in the file . <br /> Temporary settling ponds will be constructed on the site to <br /> collect water from the material washing at the processing plant . The <br /> settling ponds will be removed during final reclamation. The fines <br /> in the wash-water settle out in the ponds and the water is then <br /> recirculated to be used again in the processing plant .
