The narrative in Section 6.1.1.1 has been revised to reflect this information. <br /> 45. Clarify if mulch will be applied to both the wetlands and upland areas? <br /> The application of mulch is limited to the upland areas. No mulching is proposed on the wetland fringe <br /> as it could be seasonally inundated every year during typical conditions,based upon the measured <br /> groundwater levels. <br /> 46. Based on adequacy response#32, mulch will be applied hydraulically. Please explicitly state the <br /> mulching application method utilized within section 6.1.1.6 where the mulching rates are <br /> provided, pursuant to Rule 6.4.5(2). <br /> This is now Section 6.1.1.3(due to the recommendations to move information to other sections in the <br /> document). The 4'bullet in this section has been revised to state, "Mulch will be applied at a rate of <br /> 1.5 tons/acre of hay(preferred)or 2 tons/acre of straw. Mulch will cover the entire site with no bare <br /> areas, to a depth of between 1"--2". Mulch will be anchored by mechanical crimping,followed by <br /> mulch tackifter. Mulch will not be applied during windy conditions." <br /> 47. Adequacy response to question 25 review states that the operations are will not be reclaimed, <br /> rather it will be used for long term equipment storage. However section 6.6.1 states that the <br /> Operations Area will be reclaimed. Pursuant to Rule 6.4.5(2)(a)will the Operations Area be <br /> reclaimed to upland or will it remain stabilized with gravel post reclamation? <br /> This comment was an oversight in the previous application. The Operations Pad will be gravel(per <br /> Phase 2 construction method)and used to temporarily store equipment. <br /> 48. Please clarify the size of the Operations Area.The Mine Plan Figures 9 and 10, Exhibits C4 and <br /> C5, state that the Operation Area is 1.93 acres while section 6.6.1 states that 6.5 acres of the <br /> Operation Area will be reclaimed to upland (in addition to the 2.87 acres for upland berms). <br /> Please explain the difference in size or correct figure(s)as necessary. <br /> The Operations Area will be constructed and maintained at a size of 1.86 acres. This area will be <br /> surfaced with Class 6 roadbase,and will not be reclaimed but retained for Scott's use after the <br /> cessation of mining activity and completion of final reclamation.All figures have been updated to <br /> reflect this size, and specifically Figure 14 Exhibit E1 provides final acreages and earthwork volumes <br /> for all features of the mine at all Phases of development,including the Operations Area. <br /> 49. Section 6.1.1.1 states that no structural fill will be imported for reclamation,while section 6.3.1 <br /> states if necessary, additional spoils will be used to fill part of the pond. Please commit to <br /> revising the mining and/or reclamation plan(s)through the technical revision process if in the <br /> future,the need to import outside material because necessary to complete reclamation. <br /> All references in the application to the import of structural fill have been removed. Note that the <br /> Z999CY of Class 6 material to surface the Operations Area will be imported.Scott will commit to <br /> revising the mining and/or reclamation plan(s)through the technical revision process if there is an <br /> unforeseen need to import outside material. <br /> 50. The Division disagrees that because the site is being wet mined there is no need for <br /> decompaction.Slopes/banks will be compacted while excavations occur and therefore should <br /> be decompacted prior to topsoil application. Similarly if the Operations area is to be reclaimed it <br /> too shall be decompacted. Please revise the reclamation plan to commit to decompacting all <br /> affected lands prior to topsoil application and seeding per Rule 6.4.5(2)(d). <br /> Scott will commit to decompacting all affected lands prior to topsoil application and seeding,as <br /> 9 <br />
