DRMS Fifth Adequacy Comment <br /> Raptor Materials, LLC(RM)should revise the Extraction Plan(Exhibit D) to include a paragraph <br /> discussing operation of the conveyor that is proposed to extend from the extraction area to the <br /> processing area and over the Big Thompson River. To protect the Severe Winter Range of Mule <br /> Deer, the conveyor should only be operated between S am and 5 pm during the months of <br /> December through April. In addition, construction of the conveyor should also follow this <br /> schedule,and RM should avoid open trenches or pits that could harm animals during <br /> construction of the conveyor. Finally, RM should commit to limiting the use of lights on the <br /> conveyor in the riparian areas. <br /> Raptor has discussed the proposed restriction on operation during the months of December <br /> through April with both Rob Zuber,DRMS Environmental Protection Specialist,and Michael <br /> Grooms of the Colorado Division of Wildlife who had raised this question. Raptor's <br /> understanding subsequent to these conversations is some misunderstanding had taken place <br /> and Mr.Grooms concern was primarily for impacts on wildlife using the riparian corridor along <br /> the South Platte River during winter months.As there is no significant concern with the Big <br /> Thomson River corridor,the need to limit operation of a conveyor crossing the Big Thompson <br /> River riparian corridor between the hours of 8 am and 5 pm did not require further response, <br /> however it remained appropriate to consider the other requests.
