water quality issues, and provide a surface water and groundwater monitoring <br /> program that meets all applicable requirements; 2) submit an interim financial <br /> warranty in the amount of$162,841.00 to operate any necessary water treatment <br /> system at the site; 3) submit, by the end of every calendar quarter, beginning with <br /> the first quarter of 2022, a written report outlining the activities undertaken at the <br /> site during the current quarter and any activities planned for the next quarter to <br /> ensure compliance with section 34-32-116(7)(g), C.R.S. and Rule 3.1.6(1); and 4) <br /> appear at the Board's December 2022 meeting to provide a status update on the <br /> corrective actions required by the February 18, 2022 Order. <br /> 4. The Board also ordered Operator to cease and desist "any further <br /> activities underground, except those activities approved by the Division, in writing, <br /> as necessary to comply with the conditions of this Order, protect water quality, <br /> prevent damage to off-site areas, complete reclamation, or to protect public health <br /> and safety, until all of the corrective actions have been resolved to the satisfaction <br /> of the Division." <br /> 5. At the Board's January 18, 2023 meeting, the Division presented <br /> testimony regarding Operator's request that the cease-and-desist order be lifted. <br /> The Division discussed each of the corrective actions required by the February 18, <br /> 2022 Order and Operator's compliance with those requirements. Operator had <br /> complied with the requirement to submit a technical revision regarding water <br /> management and monitoring. Operator had submitted the required interim <br /> financial warranty. Operator has also been complying with the requirement to <br /> submit quarterly reports and had been working with the Division to address <br /> deficiencies in some of those reports. Though Operator had not appeared at the <br /> December 2022 Board meeting to provide a status update, it had requested a <br /> continuance to the January 18, 2023 meeting. The Division stated it would not <br /> approve any activities at the site that would affect the monitoring and analysis of <br /> water. Though the Division did not take a position on Operator's request to the <br /> Board to lift the cease-and-desist order, the Division presented testimony that <br /> Operator had complied with the required corrective actions. <br /> 6. Operator also presented testimony regarding its efforts to comply with <br /> the February 18, 2022 Order's corrective actions. Regarding its obligation to appear <br /> and update the Board regarding the corrective actions, Operator agreed with the <br /> Division's presentation and requested that the Board treat that testimony as the <br /> required update.
