BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> Notice of Violation No. MV-2021-017 <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br /> IN THE MATTER OF POSSIBLE VIOLATION BY GRAND ISLAND RESOURCES, <br /> LLC, CIVIL PENALTIES, CEASE AND DESIST ORDER, AND CORRECTIVE <br /> ACTIONS FOR FAILURE TO MINIMIZE DISTURBANCES TO THE PREVAILING <br /> HYDROLOGIC BALANCE, File No. M-1977-410 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br /> January 18, 2023 via videoconference to consider a request by Grand Island Resources, <br /> LLC ("Operator"), to amend the Board's order for violation MV-2021-017 to lift the <br /> cease and desist order for failure to minimize disturbances to the prevailing <br /> hydrologic balance, File No. M-1977-410. Patrick Lennberg, Jared Ebert, and Senior <br /> Assistant Attorney General Scott Schultz appeared on behalf of the Division of <br /> Reclamation, Mining and Safety ("Division"). Daniel Takami and Robert Botts, Esq. <br /> appeared on behalf of the Operator. <br /> The Board, having considered the parties' presentations, testimony, and the <br /> administrative record, and being otherwise fully informed of the facts in the matter, <br /> enters the following: <br /> FINDINGS OF FACT <br /> 1. The Operator currently holds a 110(2) reclamation permit for a 9.9 <br /> acre gold, silver, zinc, copper, and lead mine located in Section 9, Township 1 South, <br /> Range 73 West, 6th Principal Meridian in Boulder County, Colorado, permit <br /> number M-1977-410. The permitted site, known as the Cross Gold Mine, is located <br /> outside Nederland, Colorado. <br /> 2. The site was the subject of hearings and a Board Order, effective <br /> February 18, 2022, (the "February 18, 2022 Order") which found Operator in <br /> violation of section 34-32-116(7)(g), C.R.S. and Rule 3.1.6(1) for its failures to <br /> minimize disturbances to the prevailing hydrologic balance of the affected land and <br /> of the surrounding area and to the quality of water in surface systems during the <br /> mining operation and during reclamation. <br /> 3. The February 18, 2022 Order required Operator to complete four <br /> corrective actions: 1) file a Technical Revision by February 28, 2022, to modify the <br /> water management and treatment program for the site to sufficiently address all <br /> 1 <br />
