The permit was revoked and the $18,000.00 bond was forfeited in <br /> 2007. Reclamation was delayed for a number of years because the landowner, Gene Komer, was in the process of filing a <br /> plan for augmentation to replace water depletions caused by the gravel pit. On October 4, 2010 a final decree was entered <br /> in Water Court for Case No. 02CW123 and it no longer became necessary for the Division to address mitigation of the pit <br /> exposing groundwater. <br /> In 2011 reclamation was performed on site and consisted of extending the outlet pipe for the pond, disposing of concrete, <br /> dirt and rock in the south east corner of the property, regarding the irrigation ditch to allow positive drainage, install a <br /> woven wire fence, weed control and revegetating select areas of the site. The cost for the project was $8,688.00. The <br /> Division held on to the remaining funds to determine if future maintenance on the site is needed. <br /> The site was inspected in 2016 and no further reclamation work is required. Areas around the pond are well vegetated and <br /> the landowner is mowing the upland areas to control weeds.
