Tiffany <br /> Vice President and Acting President <br /> Leadville Corporation <br /> 96 Lakeshore Drive <br /> Corpus Christi, TX 78413 <br /> Subject: Reclamation of the Sherman Mine Site, Revoked Permit M1977-249 <br /> Dear Mr. Tiffany: <br /> This letter is in regard to the former Sherman Mine Site, once permitted under the <br /> now revoked Mining Permit#M1977-249. On January 31, 2005,the Division of <br /> Minerals and Geology (now known as the Division of Reclamation,Mining and <br /> Safety) ("Division")issued a letter stating a new bond for this site was required in <br /> the amount of$765,443. The operator, Leadville Corporation,failed to submit the <br /> required bond by the extended deadline. After holding a hearing,the Mined Land <br /> Reclamation Board ("Board") found a violation of§34-32-117,C.R.S. The Board <br /> ordered the operator to submit an updated financial warranty or complete <br /> reclamation within 60 days of the Board's order. The Board order was signed on <br /> August 12,2005, thereby giving the operator until October 11,2005,to comply. <br /> Leadville Corporation failed to comply. <br /> Accordingly, on October 12,2005, the Division issued a letter stating it had reason <br /> to believe that Leadville Corporation was in violation of§34-32-124, C.R.S. for <br /> failure to comply with conditions of a Board order. After holding another hearing <br /> on this matter, the Board found that the operator had violated a permit provision <br /> and therefore revoked the above-cited permit and forfeited the bond on December <br /> 5,2005. <br /> Thus,at this time,no entity has any right to mine or re-open this mine.
