IMBASELINE <br /> Engineering • Planning - Surveying <br /> Colorado Division of Reclamation, Mining and Safety <br /> Department of Natural Resources <br /> February 22, 2023 RECEIVED <br /> RE: Korwell Land Holdings, LLC, Korwell Dirt, File No. M-2022-034 FEB 2 3 2023 <br /> 112c Permit Application Adequacy Review WELD <br /> D COUNTY <br /> COMMISSIONERS <br /> Dear Peter Hays, <br /> Baseline Corporation, representing Korwell Land Holdings, is in receipt of the Adequacy Review <br /> Memo dated January 27, 2022 concerning the DNR 112c permit for Korwell Dirt. We have reviewed <br /> the aforementioned memo and have made appropriate revisions to the previously submitted <br /> application materials. Below, we have provided written respons, to each of the comments. <br /> 1. 1.6 Public Notice: Pursuant to Rule 1.6.2(e), please submit proof of the notice to all owners <br /> of record of surface and mineral rights of the affected land and the owners of record of all land <br /> surface within 200 feet of the boundary of the affected land including all easement holders <br /> located on the affected land and within 200 feet of the boundary of the affected land. Proof of <br /> notice may be return receipts of a Certified Mailing or by proof of personal service. <br /> The applicant submitted Certified Mail Receipt tracking information for the following owners <br /> of record of all land surface within 200 feet of the boundary of the affected land, however the <br /> owners of record are not indicated on the Exhibit C map. Please explain these discrepancies. <br /> a) Edward and Heather Dascanio <br /> b) M&B Ag LLC <br /> Response: Edward and Heather Dascanio own a property to the SE of the site. The land is <br /> not within 200 feet of the boundary of the affected land, but a letter was sent to them anyways <br /> as a courtesy. Owner information has also been added on top of their property to clarify <br /> (bottom right of exhibit). M&B Ag LLC is the same property owner as Leila Berig (Same P.O. <br /> box address as well). 2 letters were sent to the P.O. Box with each name in order to cover all <br /> bases. I added an aka M&B AG LLC to their owner information to clarify. <br /> The Division did not receive proof of notice for the following owners of record of the surface <br /> and mineral rights of the affected land and the owners of all land surface within 200 feet of <br /> the affected land, including all easement holders located on the affected land and within 200 <br /> feet of the boundary of the affected land. Please provide proof of notice pursuant to Rule <br /> 1.6.2(1)(f)for the following owners of record: <br /> a) Weld County— WCR 35 and WCR 40 <br /> b) Xcel Energy <br /> Response: Certified letters were mailed to these entities on February 1, 2023. Please note <br /> the Green return cards have not been located, but USPS's website indicates they have been <br /> delivered. I have attached screenshots of the website for proof.
