RE: J-2 Contracting Company. — Hunt Irrigation Pond, File No. M-2022-050, Special Operation <br /> 111(1)(b) Reclamation Permit Application Adequacy Review Letter Response <br /> 1120123 <br /> -2- <br /> 4. In Exhibit C, the applicant provides dimensions of Weld County Road 40 and the access <br /> road to the site as 24ft wide. Please include the equipment that will be used during mining <br /> and reclamation in the mining plan narrative. Please also state whether the roads will <br /> require significant improvements beyond routine maintenance. <br /> Response: The equipment that will be used during the mining has been provided <br /> in the updated Exhibit C. The roads will only require routine maintenance. J2 <br /> Contracting Co. has a road maintenance agreement with Weld County. <br /> Exhibit D— Reclamation Plan (Rule 6.3.4) <br /> 5. In Exhibit D, item #11 asks the applicant to "state the type, application rate, and crimping <br /> method of mulch if any:". The applicant left this blank, implying that no mulch will be used. <br /> In the cost estimate provided by the applicant, "seed and mulch" is listed under the 'activity' <br /> column. Please clarify if mulch will be required during revegetation, if so, fill out item#11 in <br /> its entirety. <br /> Response: Mulch will be included and will be crimped. Item 11 has been updated <br /> and is attached in the updated Exhibit D. <br /> Exhibit L— Permanent Man-Made Structures (Rule 6.3.12) <br /> 6. The Applicant provided unexecuted structure agreements with all structure owners within <br /> 200 feet of the affected boundary with the permit application. Please provide the Division <br /> with copies of any/all structure agreements signed by the structure owners. <br /> Response: One structure agreement that was signed by Cureton was forwarded on <br /> to the Division of Reclamation, Mining, and Safety via e-mail to Peter Hays on <br /> 11121122. The signed agreement is attached for reference. E-mail correspondence <br /> is provided for PDC and Xcel Energy. Letters from David Hunt and Chris Leone are <br /> provided for the remaining agreements. <br /> Other <br /> 7. The Division received state agency comments from the Division of Water Resources and <br /> the Army Corps. of Engineers. The letters are attached for review. Please revise the <br /> permit exhibits accordingly in response to the letters. <br /> Response: The DWR comments have been addressed as no groundwater will be <br /> exposed for this mining. Groundwater is being monitored in the area so that <br /> groundwater will not be exposed by recording data from a nearby monitor well. The <br /> reclaimed clay liner will not affect the groundwater as it is going to be above <br /> groundwater and only used to keep water from seeping/leaking from the reclaimed <br /> irrigation pond. <br /> The Army Corps of Engineers provided an approved jurisdictional determination for <br /> this site (this was forwarded on to the Division of Reclamation, Mining, and Safety <br /> via e-mail to Peter Hays on 12120122) so no wetlands or waters of the US will be <br /> affected by this project/mining. <br /> 8. Pursuant to Rule 1.6.2(2), please demonstrate that the Applicant's response to these <br /> adequacy issues have been placed with the application materials previously placed with <br /> the County Clerk or Recorders Office, and made available for public review <br /> Response: The response has been placed with the application materials previously <br /> placed with the County Clerk to the Board.
