No public use of these facilities <br /> will be allowed. <br /> 2.10 Garfield County LUDC: Article 7—Standards <br /> 2.10.1 Division 1 —General Approval Standards <br /> Section 7-101. Zone District Use Regulations <br /> The property is currently zoned Rural, and this application proposes to pursue gravel mining <br /> activities on this property. All requirements of Article 3, Zoning, will be met with this proposal, <br /> through the Major Impact Review—Land Use Change Permit process. <br /> Section 7-102. Comprehensive Plan and Intergovernmental Agreements <br /> The Garfield County Comprehensive Plan -2030 addresses mining in Chapter 3, Section 9 — <br /> Mineral Extraction. It states that Garfield County has significant mineral resources that <br /> provide, and will continue to provide, a considerable benefit to the economic health of the <br /> county. The goals set in place seek to ensure that mineral extraction is regulated appropriately <br /> and promotes responsible development. The Future Land Use map from the Comprehensive <br /> Plan illustrates the subject property as Residential Medium High (RMH). Scott goes into detail <br /> in various reports and narratives as how the proposed mining operations will operate in <br /> conformance with multiple regulatory agencies. Scott's adherence to regulatory policies and <br /> rules will result in limited, short-term impacts to the surrounding properties while infusing <br /> economic benefits, promoting a thriving community, and minimizing impacts to wildlife. <br /> Section 7-103. Compatibility <br /> The nature, scale, and intensity of the proposed gravel mining operation will be compatible <br /> with adjacent land uses. The surrounding land uses are mixed industrial and agricultural in <br /> nature; there is an oil/gas pad immediately to the west, an open pit aggregate mine less than <br /> 0.5 miles to the west, and agricultural uses to the north and east. Garfield County is a "Right <br /> to Mine" County guaranteeing mineral rights owners the right to extract minerals in all zone <br /> districts of the county. Visual and sound impacts will be mitigated with Garfield County <br /> Conditions of Approval and DRMS Standards. <br /> Section 7-104. Source of Water <br /> The project has a legal and adequate water supply plan. Impacts to local groundwater and <br /> surface water have been avoided by utilizing a wet-mining approach that will not disrupt <br /> existing groundwater flows or elevations. As described, no pumping, piping, or discharge of <br /> collected waters will be required. <br /> Augmentation to offset evaporative losses from the exposed groundwater in the pond and the <br /> wet aggregate, as well as dust control uses, is required per Colorado's Revised Statutes <br /> (CRS) to protect downstream senior water right holders. Scott has developed a <br /> Supplementary Water Supply Plan (SWSP) that estimates the annual losses during active <br /> operations at 66 acre-feet, and the annual losses after reclamation at 44 acre-feet(solely due <br /> to evaporation from the pond surface).These losses will be augmented by Scott in accordance <br /> with CRS requirements and Division of Water Resources requirements. <br /> Section 7-105.
