PART <br /> Page 10 of 67 <br /> Permit No.: COG500000 <br /> iv. the permittee provides documentation with the Notice of Termination request that the above conditions for <br /> termination have been met for the facility,and includes photographic documentation of final stabilization <br /> conditions. <br /> c. The permittee has obtained authorization under an individual or alternative general permit for all facility discharges. <br /> d. No Exposure Certification. If the facility authorized to discharge stormwater-only under this permit becomes eligible <br /> for a no exposure exclusion from permitting under 5 CCR 1002-61.3(2)(h),the permittee may submit a complete and <br /> accurate No Exposure Certification to the Division at the address listed in Part I.A.4. The Division will terminate permit <br /> coverage using information provided in the No Exposure Certification form;the permittee does not need to submit a <br /> Notice of Termination. <br /> The Division may,after consultation with the permittee and upon good cause, revise the vegetative cover requirements on <br /> a case-by-case basis. <br /> B. PERMIT COMPLIANCE — Process water and stormwater <br /> A permittee must comply with all the terms and conditions of this permit.Violation of the terms and conditions specified in this <br /> permit may be subject to civil and criminal liability pursuant to sections 25-8-601 through 612,C.R.S.. Correcting a permit violation <br /> does not remove the original violation. Failure to take any required corrective actions,as detailed in Part LK(Corrective Actions), <br /> constitutes an independent,additional violation of this permit and may be subject to civil and criminal liability. However,where <br /> corrective action is triggered by an event that does not itself constitute permit noncompliance, such as an exceedance of an <br /> applicable benchmark,there is no permit violation unless the permittee fails to take the required corrective action within the <br /> relevant deadlines. <br /> 1. Facilities Operation and Maintenance <br /> The permittee shall at all times properly operate and maintain all facilities and systems of treatment and control which are <br /> installed or used by the permittee as necessary to achieve compliance with the conditions of this permit. Proper operation and <br /> maintenance also includes effective performance,and adequate laboratory and process controls, including appropriate quality <br /> assurance procedures. This provision requires the operation of back-up or auxiliary facilities or similar systems when installed <br /> by the permittee only when necessary to achieve compliance with the conditions of the permit. <br /> Any sludge produced at the wastewater treatment facility shall be disposed of in accordance with State and Federal guidelines <br /> and regulations. The permittee shall take all reasonable steps to minimize or prevent any discharge of sludge use or disposal in <br /> violation of this permit which has a reasonable likelihood of adversely affecting human health or the environment. As <br /> necessary,accelerated or additional monitoring to determine the nature and impact of the noncomplying discharge is required. <br /> C. EFFLUENT LIMITATIONS and MONITORING REQUIREMENTS <br /> In accordance with the Water Quality Control Commission Regulations for Effluent Limitations,Section 62.5;the Colorado Discharge <br /> Permit System Regulations,Section 61.8(2),5 C.C.R. 1002-61; and the effluent limitation guidelines found 40 CFR Part 436(Mineral <br /> Mining and Processing Point Source Category),the permitted discharge shall not contain effluent parameter concentrations that <br /> exceed the effluent limitations identified in this Part,and specified in the permit certification. <br /> 1. Process Water Discharge Effluent Limitations <br /> The permittee shall monitor the effluent consistent with the requirements identified in Tables C.1.1 through C.1.6 and <br /> specified in the permit certification,as applicable to the permitted feature. <br /> "Report Only" monitoring requirements for additional site-specific parameters may be included in the permit certification to <br /> obtain additional effluent quality data. <br /> The permittee must conduct all required monitoring and reporting consistent with Parts LE and I.F of this permit, unless <br /> otherwise noted. <br />
