The following is a discussion of the stipulations that were noted as active or
issued as a result of the last Permit Renewal (RN-7). The review included an investigation of the
stipulation response file, revisions to the permit, and the findings document for RN-7.
Stipulations are a binding part of the permit and previously assigned stipulation numbers are not
re-used. Any stipulations associated with the Deserado Mine permit and issued over the life of
the operation which are not discussed in this Midterm Review document have been complied
with or terminated.
There are two active stipulations for the Deserado Mine. All of the stipulations are perpetual in
nature and impose possible future obligations on the permittee when conducting operations on
BLM lands.
Stipulation No. 50
IF THE OPERATOR DISCOVERS ANY CULTURAL REMAINS, MONUMENTS OR SITES,
OR ANY OBJECT OF ANTIQUITY, OPERATOR SHALL IMMEDIATELY CEASE
ACTIVITY AND REPORT DIRECTLY TO BLM AREA MANAGER. THE BLM SHALL
TAKE ACTION AS REQUIRED UNDER THE ACTS AND REGULATIONS. OPERATOR
SHALL FOLLOW MITIGATION REQUIREMENTS SET FORTH BY BLM CONCERNING
PROTECTION, PRESERVATION OR DISPOSITION OF ANY SITES OR MATERIAL
DISCOVERED. COST OF SALVAGE EXCAVATION, IF NECESSARY, SHALL BE
BORNE BY THE OPERATOR UNLESS OTHERWISE STATED.
Deserado Mine -4- 12/21/2022
