«* <br /> iii) All three Hunt Brothers parcels have been annexed into the City of Evans and are zoned <br /> heavy industrial (1-3)with a city approved site plan for sand and gravel mining, material <br /> processing and hot asphalt plant operations. <br /> iv) The City of Evans determined during the site plan process for the mining operation that no <br /> additional street access permits or use agreement are required to use the undeveloped 35"' <br /> Avenue right of way prior to any street development. <br /> v) The annexation of the land by the City of Evans includes zoning of the Hunt Brothers <br /> property as a Heavy Industrial District, 1-3, per the City of Evans—Municipal Code,Title 18— <br /> Land Development Code,Chapter 18, 18.04.080—C.Heavy Industrial District(1-3).The <br /> purpose of this zoning is to expand the cities heavy industrial district and industrial uses that <br /> are found within the city limit. Heavy industry consists of uses such as quarry and gravel pits, <br /> asphalt plants, ready mix concrete plants, large-scale industry, used auto parts, incinerators, <br /> and other similar operations. <br /> 3) The site reclamation plan calls for phased reclamation that includes two overall tasks; 1) inert <br /> material backfill and 2)grading topsoil to establish a viable dryland pasture with forbs and grasses. <br /> a) The reclamation phases are divided into five total phases; phase 1 is a commercial/industrial <br /> area and phases 2 through 5 are sand and gravel mining areas. <br /> b) Phase 1 (industrial/Commercial Operation) is being operated as a commercial asphalt hot <br /> plant, recycle aggregate material operation and aggregate wash plant businesses that will <br /> process imported and onsite materials. <br /> i) Phase 1 will remain active for the duration of Phase 2 through 5 mining activity. <br /> ii) Phase 1 wash plant operation will require minimal excavation for the settling ponds(±2.4 <br /> acres)and ditches. <br /> iii) Material will be imported from other off-site locations for processing into saleable asphalt, <br /> recycle aggregate and washed aggregate products within the Phase 1 area. <br /> iv) Import and onsite wash plant inert fines will become backfill for the mining phases 2 <br /> through S. <br /> v) The Phase 1 wash plant and associated infrastructure will be removed as part of the final <br /> reclamation of the property.The wash plant settling ponds and associated ditches will be <br /> filled with clean inert backfill material,topsoil grading and planting with the dryland pasture <br /> forbs and grasses seed mix. <br /> vi) The Phase 1 hot asphalt plant, recycle aggregate operation,office and truck scale will <br /> remain as part of the final reclamation of the property. No inert backfill is associated this <br /> reclamation of this portion of the area.The phase 1 commercial/industrial land <br /> reclamation will include topsoil grading and planting with reclamation forbs and grasses <br /> seed mix. <br /> c) The Phase 2 through 5(Sand and Gravel Mine) mine reclamation will return the land to usable <br /> dryland pasture property. <br /> i) The minable area is±87.6 acres that is divided into four mine phases designated 2 through <br /> 5. <br /> ii) Four mine phases(Ph 2 -5)will be filled and compacted with clean inert backfill to an <br /> elevation±two(2)feet above the ground water table.The ground water table is 6 to 8 feet <br /> below the ground surface. <br />
