replaced at locations necessary to prevent injury." The addition of the Subject Wells
to the WAS Plan for Augmentation does not require adjustments to the percentages
used to distribute stream depletions. The addition of the Subject Wells to the WAS
Plan for Augmentation will not change the total volume of replacement allocations
for WAS Member Wells.
CONCLUSIONS OF LAW
H. Paragraphs l through 10, inclusive, are incorporated herein by reference to the
extent they constitute conclusions of law.
12. Jurisdiction. The Court has jurisdiction of the subject matter of this decree and all
persons affected hereby, whether they have appeared or not, pursuant to §37-92-
203(l), §37-92-302 and §37-92-304, C.R.S.
13. Application. The Application was filed with the Water Court pursuant to §37-92-
302, CR.S.
14. Notice. Full and adequate notice of the claim adjudicated herein has been given in
the manner required by law.
15. Can and Will. The Court hereby concludes that the Applicant has established that
water can and will be diverted under the subject conditional water rights and will be
beneficially used, and completed with diligence and within a reasonable time.
RULING AND DECREE
16. Paragraphs 1 through 15, inclusive, are incorporated herein by reference and made a part
of this Ruling and Decree as if fully set forth.
17. The Court hereby confirms the addition of the Wells to the Plan for Augmentation to be
used in accordance with all terms and conditions applicable to Augmentation Wells
decreed in Case No. 03CW99 as described in Paragraph 9 above.
18. Accounting and Reporting. Prior to the use of the Subject Wells for industrial purposes,
the well owner shall secure a well permit for such purposes from the State Engineer. The
Applicant shall maintain diversion records for the water rights decreed herein and shall
report and account for such diversions and out of priority depletions by the wells
consistent with the accounting and reporting requirements required pursuant to the
Augmentation Plan decreed in Case No. 03CW99. Such accounting for the water rights
decreed herein shall be integrated into the forms approved for the 03CW99 Augmentation
Plan and shall be subject to modification consistent with that decree.
