The addition of the Subject Wells <br /> to the WAS Plan for Augmentation does not require adjustments to the percentages <br /> used to distribute stream depletions. The addition of the Subject Wells to the WAS <br /> Plan for Augmentation will not change the total volume of replacement allocations <br /> for WAS Member Wells. <br /> CONCLUSIONS OF LAW <br /> H. Paragraphs l through 10, inclusive, are incorporated herein by reference to the <br /> extent they constitute conclusions of law. <br /> 12. Jurisdiction. The Court has jurisdiction of the subject matter of this decree and all <br /> persons affected hereby, whether they have appeared or not, pursuant to §37-92- <br /> 203(l), §37-92-302 and §37-92-304, C.R.S. <br /> 13. Application. The Application was filed with the Water Court pursuant to §37-92- <br /> 302, CR.S. <br /> 14. Notice. Full and adequate notice of the claim adjudicated herein has been given in <br /> the manner required by law. <br /> 15. Can and Will. The Court hereby concludes that the Applicant has established that <br /> water can and will be diverted under the subject conditional water rights and will be <br /> beneficially used, and completed with diligence and within a reasonable time. <br /> RULING AND DECREE <br /> 16. Paragraphs 1 through 15, inclusive, are incorporated herein by reference and made a part <br /> of this Ruling and Decree as if fully set forth. <br /> 17. The Court hereby confirms the addition of the Wells to the Plan for Augmentation to be <br /> used in accordance with all terms and conditions applicable to Augmentation Wells <br /> decreed in Case No. 03CW99 as described in Paragraph 9 above. <br /> 18. Accounting and Reporting. Prior to the use of the Subject Wells for industrial purposes, <br /> the well owner shall secure a well permit for such purposes from the State Engineer. The <br /> Applicant shall maintain diversion records for the water rights decreed herein and shall <br /> report and account for such diversions and out of priority depletions by the wells <br /> consistent with the accounting and reporting requirements required pursuant to the <br /> Augmentation Plan decreed in Case No. 03CW99.
