Future Depletions from Previous Pumping. The irrigation use of the Subject Wells <br /> is already included in the WAS Plan. In addition, by the decree entered in <br /> 08CW0071 the Subject Wells were included in and replacements have been made <br /> pursuant to the PVIC Augmentation Group, LLC Augmentation Plan (WDID <br /> 0205294) (the "PVIC Plan"). For these reasons and because the Subject Wells <br /> have not yet been used for the new conditional industrial uses, there are no <br /> depletions from prior pumping of the Subject Wells for industrial uses that need <br /> to be augmented as a result of the addition of the Subject Wells to the WAS Plan, <br /> and no additional depletions from previous pumping will be added to the WAS <br /> Plan upon entry of a decree in this case. Depletions from previous pumping of the <br /> Subject Wells for irrigation uses will be replaced pursuant to the WAS Plan and <br /> the PVIC Plan. <br /> 9.4. Future pumping of the Subject Wells for irrigation use and for industrial use <br /> under the WAS Plan will be separately metered and all pumping under the WAS <br /> Plan shall be separately metered from pumping under any other augmentation <br /> plan. <br /> 9.5. Except as decreed herein, all other terms and conditions of the WAS Plan remain <br /> applicable to the Subject Wells. Pumping of the Subject Wells will be in <br /> accordance with said terms and conditions, and the terms and conditions of <br /> applicable permits and decrees for the Subject Wells, including this case and Case <br /> No. 20CW3070. <br /> 10. Distribution of Future Well Depletions.
