ROAD MAINTENANCE AGREEMENT ACCORDING TO <br /> REQUIREMENTS DURING THE CONSTRUCTION PERIOD <br /> David&Kayleen Hunt c/o J-2 Contracting Co.—TAP22-0019,TAP22-0020, TAP22-0021 <br /> THIS AGREEMENT is made this day of , 202_, by and between David & <br /> Kayleen Hunt c/o J-2 Contracting Co., a company organized under the laws of the State of Colorado, whose <br /> address is 105 Coronado Court,Unit A-101,Fort Collins,Colorado 80525,hereinafter referred to as"Property <br /> Owner," authorized to do business in the State of Colorado, and the County of Weld, a body corporate and <br /> politic of the State of Colorado, by and through its Board of County Commissioners, whose address is 1150 <br /> "O"Street, Greeley,Colorado 80631 hereinafter referred to as"County." <br /> WITNESSETH: <br /> WHEREAS,Property Owner is the owner of the following described property in the County of Weld, <br /> Colorado: <br /> Part of Section 29, Township 4 North, Range 66 West of <br /> the 6th P.M.,Weld County,Colorado <br /> hereinafter referred to as"the Property,"and <br /> WHEREAS, Property Owner has received the Weld County Department of Planning Services <br /> conditional approval of TAP22-0019,TAP22-0020,and TAP22-0021;and <br /> WHEREAS, the Property Owner facility will generate additional vehicles and heavy traffic directly <br /> associated with TAP22-0019,TAP22-0020,and TAP22-0021,for an extended period of time;and <br /> WHEREAS, the County will cease all maintenance of the roadways directly associated with <br /> TAP22-0019, TAP22-0020, and TAP22-0021 during the six (month) construction timeline, and the Property <br /> Owner shall be solely responsible of maintenance of the impacted roadways; and <br /> WHEREAS, the County, and Property Owner are desirous of agreeing to terms involving regulation <br /> of haul routes, traffic control, and road wear arising from such additional traffic as described in this <br /> Agreement and depicted in the following incorporated exhibits: <br /> Exhibit A—Approved Haul Route Road Map and <br /> Exhibit B—Gravel Roads Maintenance and Reclamation Plan. <br /> NOW, THEREFORE, IN CONSIDERATION OF the foregoing and of the promises and covenants <br /> contained herein,the parties hereto promise,covenant,and agree as follows: <br /> Part I: SITE SPECIFIC PROVISIONS <br /> A. Reserved <br /> B. Approved Haul Route Road: Property Owner shall be financially responsible for the associated <br /> costs for maintaining and/or improving designated haul routes,as shown on the attached Exhibit A. <br /> 1.0 Haul Route. The following roads are designated as haul/travel routes for the Property: <br /> 1)East and west along CR 40 between Highway 60 and Highway 85. <br /> 2.0 Duration.
