Processing at the site will be limited to screening for size. No groundwater will be <br /> exposed, and no dewatering will take place at the site. <br /> 3. In accordance with Rules 1.6.2(1)(d) and 1.6.5(1) of the Mineral Rules <br /> and Regulations of the Colorado Mined Land Reclamation Board for the Extraction <br /> of Construction Materials, 2 CCR 407-4 ("Rules"), the Applicant published the <br /> initial notice in the Golden Transcript on September 16, 2021, with the public <br /> comment period ending on October 27, 2021. During this period, the Division <br /> received written objections from 27 parties. <br /> 4. During the adequacy review, it was apparent that publication of the <br /> notice only occurred once rather than once a week for four consecutive weeks as <br /> required by the Rules. The Division required republication for a full consecutive <br /> four weeks. The second notice period started on December 9, 2021, and the public <br /> comment period ended on January 19, 2022. During this second public comment <br /> period, the Division received 158 timely letters of objection. <br /> 5. In addition to the objection letters, the Division received timely <br /> comments from the Colorado Division of Water Resources, History Colorado, the <br /> Town of Golden, and a letter of support from the Colorado State Land Board. The <br /> Division received untimely comments from Colorado Parks and Wildlife on June 3, <br /> 2022. <br /> 6. During the review period, the Division generated three adequacy <br /> review letters. The Applicant addressed all of the Division's adequacy issues to the <br /> Division's satisfaction. <br /> 7. On June 30, 2022, based on the applicable requirements of the <br /> Colorado Land Reclamation Act for the Extraction of Construction Materials, <br /> Article 32.5 of Title 34, C.R.S. ("Act") and the Rules, the Division issued and served <br /> on all parties both a written recommendation for approval of the Application over <br /> objection and a written rationale for that recommendation. <br /> 8. On July 7, 2022, the Board, through a prehearing officer, conducted a <br /> prehearing conference. 14 objectors attended the prehearing conference and <br /> retained party status and 171 objectors forfeited party status by failing to attend <br /> the prehearing conference. The prehearing officer issued a draft prehearing order. I <br /> Among other things, the draft prehearing order identified jurisdictional issues to be <br /> presented to the Board. <br /> 9. On July 9, 2022, Objectors William O'Brien, Michael Rawluk, and <br /> Gerald Wayman filed a motion requesting that the Board deny the Application, on <br /> behalf of an organization called"Protect the Hogback."
