BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> i <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW,AND ORDER <br /> IN THE MATTER OF THE APPLICATION FOR 110C TO 112C PERMIT <br /> CONVERSION OF DENVER BRICK COMPANY; File No. M-1976-007-UG <br /> THIS MATTER came before the Mined Land Reclamation Board (`Board") on <br /> July 21, 2022, with the Board meeting in-person and presentations via <br /> videoconference for a hearing to consider the application of Denver Brick Company <br /> ("Applicant") to convert its 110c permit to a 112c permit, file number M-1976-007- <br /> UG. F <br /> Eric Scott, Michael Cunningham, and First Assistant Attorney General Jeff <br /> Fugate appeared on behalf of the Division of Reclamation, Mining and Safety <br /> ("Division"). Joe Middleton, Esq.; Richard Murphy; Neal Stanta of Stanto Group, <br /> Inc.; Chris Sanchez and Tim Crawford of BBA Water Consultants, Inc.; Dr. Angela <br /> M. Bellantoni of Environmental Alternatives appeared on behalf of Applicant. <br /> Objectors Richard Bohling, Bill O'Brien, Randy Say, Gerald Wayman, Mike <br /> Rawluk, Brandon Carrino, and Joanne Scarborough appeared on their own <br /> behalf(appearing collectively as "Protect the Hogback") and Peter Kryzwicki and <br /> Ian Wilson appeared on their own behalf. <br /> The Board, having considered presentations, testimony, materials submitted, <br /> and being otherwise fully informed of the facts in the matter, enters the following: <br /> FINDINGS OF FACT <br /> 1. Applicant filed an application with the Division to convert its 110c <br /> permit to a 112c reclamation permit (the "Application") for a site known as the <br /> Golden Mine in Jefferson County, Colorado. Located in Section 16, Township 3 <br /> South, Range 70 West, 6th Principal Meridian, the Golden Mine is a 9.0-acre clay <br /> mine, with materials processed off-site. The 110c permit was issued in 1977 and <br /> transferred to Applicant in 1992. <br /> 2. The Application proposes an increase in acreage to a total of 70.15 <br /> acres permitted acres (including the 9 acres under the current permit), with <br /> approximately 47 acres to be mined. The Application's mining plan anticipates I <br /> mining continuing much as it has in the past, with limited"campaign mining" <br /> intervals lasting three to five weeks every three to five years with shipments of <br /> stockpiled materials occurring as needed. Material excavated at the site will be <br /> stockpiled for transfer off-site by truck for processing and final use or sale. <br /> I <br />
