Kiewit I Fountain Colony Pit September 6, 2022 <br /> 1.0 INTRODUCTION <br /> 1.1 Purpose and Objectives <br /> In accordance with Section 1.9 of the Mineral Rules and Regulations of the Colorado Mined Land <br /> Reclamation Board for the Extraction of Construction Materials, the purpose of this document is to <br /> support the request to the Colorado Division of Reclamation, Mining and Safety (DRMS) for a <br /> Technical Revision (TR) to the currently approved 112 Reclamation Permit and Plan for the Fountain <br /> Colony Pit, located in El Paso County (Permit M-1987-171� The objectives of this document are to <br /> update the relevant applicable sections of the Reclamation Plan, specifically Exhibits A, E, F, and L, as <br /> described under Section 6.4 of the Act. This revision is to provide for the exclusion of part of the <br /> operation where material extraction has permanently ceased, reclamation is complete,and for which <br /> a portion is presently planned for post-mining commercial/industrial development, consistent with <br /> the Reclamation Plan's designated end use. More specifically, this TR will reduce the affected land <br /> area permitted, and allow for post-mining development by another successor in interest over a <br /> portion of that area. Once approved, Kiewit Infrastructure West Co. (Kiewit) intends to occupy part <br /> of the excluded area as a lessee to stage construction equipment. For the revised area covered under <br /> the Reclamation Plan and Permit, Kiewit will remain as the operator and permittee. Upon approval <br /> of this TR,the portion of the area excluded from the Reclamation Permit and Plan will be entitled for <br /> commercial/industrial development by a separate party through a Conditional Use Permit with the <br /> City of Fountain Colorado. <br /> The Fountain Colony Pit Reclamation Permit and Plan revised Exhibits include the following: <br /> • Exhibit A- Legal Description <br /> • Exhibit E- Reclamation Plan <br /> • Exhibit F- Reclamation Plan Map <br /> • Exhibit L- Reclamation Cost Estimate <br /> This TR will allow for the exclusion of fully reclaimed Phase III and Phase IV, and portions of Phase I <br /> and Phase II that are reclaimed or undisturbed by mining activity,from the permit and affected land <br /> boundaries. <br /> Specifically, Kiewit requests that the Reclamation Permit and Plan be revised to reduce the permit <br /> area under permit number M-1987-171, by 162 acres of reclaimed and undisturbed land. With <br /> approval of this TR,the Reclamation Plan and Permit area will be 151.9 acres.The revised permit and <br /> affected area includes lands subject to reclamation as well as lands presently undisturbed. <br /> 1.2 Background <br /> Heretofore, the operator and permittee for the Fountain Colony Pit was Kiewit Western Co., which <br /> became the successor in interest in 1999. Since that time, Kiewit Western Co. merged into Kiewit <br /> Infrastructure West Co., now the operator and permittee for the Site. Accordingly,this TR addresses <br /> the proposed changes to the Reclamation Permit and Plan for the Kiewit operations. <br /> Technical Revision#4 1 Sespe Consulting, Inc. <br />
